66 AN ACT
77 relating to pharmacy networks for health benefit plans for certain
88 governmental employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 1551, Insurance Code, is
1111 amended by adding Section 1551.226 to read as follows:
1212 Sec. 1551.226. NETWORK PHARMACY PROVIDERS. (a) To achieve
1313 cost savings and economies of scale, prescription drugs provided
1414 under the group benefits program shall be provided, to the extent
1515 practicable, by a limited number of pharmacy providers that have
1616 contracted to provide the drugs through a pharmacy network.
1717 (b) The board of trustees may identify regions of the state
1818 that have an insufficient number of pharmacy providers
1919 participating in the pharmacy network and may provide that, in an
2020 identified region, prescription drug benefits may be provided
2121 through a pharmacy network established for that region.
2222 SECTION 2. Subchapter D, Chapter 1575, Insurance Code, is
2323 amended by adding Section 1575.172 to read as follows:
2424 Sec. 1575.172. NETWORK PHARMACY PROVIDERS. (a) To achieve
2525 cost savings and economies of scale, prescription drugs provided
2626 under the group program shall be provided, to the extent
2727 practicable, by a limited number of pharmacy providers that have
2828 contracted to provide the drugs through a pharmacy network.
2929 (b) The trustee may identify regions of the state that have
3030 an insufficient number of pharmacy providers participating in the
3131 pharmacy network and may provide that, in an identified region,
3232 prescription drug benefits may be provided through a pharmacy
3333 network established for that region.
3434 SECTION 3. Subchapter C, Chapter 1579, Insurance Code, is
3535 amended by adding Section 1579.109 to read as follows:
3636 Sec. 1579.109. NETWORK PHARMACY PROVIDERS. (a) To achieve
3737 cost savings and economies of scale, prescription drugs provided
3838 under the program shall be provided, to the extent practicable, by a
3939 limited number of pharmacy providers that have contracted to
4040 provide the drugs through a pharmacy network.
4141 (b) The trustee may identify regions of the state that have
4242 an insufficient number of pharmacy providers participating in the
4343 pharmacy network and may provide that, in an identified region,
4444 prescription drug benefits may be provided through a pharmacy
4545 network established for that region.
4646 SECTION 4. Subchapter C, Chapter 1601, Insurance Code, is
4747 amended by adding Section 1601.112 to read as follows:
4848 Sec. 1601.112. NETWORK PHARMACY PROVIDERS. (a) To achieve
4949 cost savings and economies of scale, prescription drugs provided
5050 under a uniform program shall be provided, to the extent
5151 practicable, by a limited number of pharmacy providers that have
5252 contracted to provide the drugs through a pharmacy network.
5353 (b) A system may identify a region served by a uniform
5454 program that has an insufficient number of pharmacy providers
5555 participating in the pharmacy network and may provide that, in the
5656 identified region, prescription drug benefits may be provided
5757 through a pharmacy network established for that region.
5858 SECTION 5. This Act takes effect September 1, 2009.
