6	6	AN ACT
7	7	relating to pharmacy networks for health benefit plans for certain
8	8	governmental employees.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subchapter E, Chapter 1551, Insurance Code, is
11	11	amended by adding Section 1551.226 to read as follows:
12	12	Sec. 1551.226. NETWORK PHARMACY PROVIDERS. (a) To achieve
13	13	cost savings and economies of scale, prescription drugs provided
14	14	under the group benefits program shall be provided, to the extent
15	15	practicable, by a limited number of pharmacy providers that have
16	16	contracted to provide the drugs through a pharmacy network.
17	17	(b) The board of trustees may identify regions of the state
18	18	that have an insufficient number of pharmacy providers
19	19	participating in the pharmacy network and may provide that, in an
20	20	identified region, prescription drug benefits may be provided
21	21	through a pharmacy network established for that region.
22	22	SECTION 2. Subchapter D, Chapter 1575, Insurance Code, is
23	23	amended by adding Section 1575.172 to read as follows:
24	24	Sec. 1575.172. NETWORK PHARMACY PROVIDERS. (a) To achieve
25	25	cost savings and economies of scale, prescription drugs provided
26	26	under the group program shall be provided, to the extent
27	27	practicable, by a limited number of pharmacy providers that have
28	28	contracted to provide the drugs through a pharmacy network.
29	29	(b) The trustee may identify regions of the state that have
30	30	an insufficient number of pharmacy providers participating in the
31	31	pharmacy network and may provide that, in an identified region,
32	32	prescription drug benefits may be provided through a pharmacy
33	33	network established for that region.
34	34	SECTION 3. Subchapter C, Chapter 1579, Insurance Code, is
35	35	amended by adding Section 1579.109 to read as follows:
36	36	Sec. 1579.109. NETWORK PHARMACY PROVIDERS. (a) To achieve
37	37	cost savings and economies of scale, prescription drugs provided
38	38	under the program shall be provided, to the extent practicable, by a
39	39	limited number of pharmacy providers that have contracted to
40	40	provide the drugs through a pharmacy network.
41	41	(b) The trustee may identify regions of the state that have
42	42	an insufficient number of pharmacy providers participating in the
43	43	pharmacy network and may provide that, in an identified region,
44	44	prescription drug benefits may be provided through a pharmacy
45	45	network established for that region.
46	46	SECTION 4. Subchapter C, Chapter 1601, Insurance Code, is
47	47	amended by adding Section 1601.112 to read as follows:
48	48	Sec. 1601.112. NETWORK PHARMACY PROVIDERS. (a) To achieve
49	49	cost savings and economies of scale, prescription drugs provided
50	50	under a uniform program shall be provided, to the extent
51	51	practicable, by a limited number of pharmacy providers that have
52	52	contracted to provide the drugs through a pharmacy network.
53	53	(b) A system may identify a region served by a uniform
54	54	program that has an insufficient number of pharmacy providers
55	55	participating in the pharmacy network and may provide that, in the
56	56	identified region, prescription drug benefits may be provided
57	57	through a pharmacy network established for that region.
58	58	SECTION 5. This Act takes effect September 1, 2009.
