66 AN ACT
77 relating to the first day of instruction at a public school.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 25.0811, Education Code, is amended to
1010 read as follows:
1111 Sec. 25.0811. FIRST DAY OF INSTRUCTION. [(a)] The board of
1212 trustees of a [A] school district shall determine the first day of
1313 [may not begin] instruction for students [for a school year before
1414 the fourth Monday in August unless the district operates a
1515 year-round system under Section 25.084].
1616 [(b) Notwithstanding Subsection (a), a school district that
1717 does not offer each grade level from kindergarten through grade 12
1818 and whose prospective or former students generally attend school in
1919 another state for the grade levels the district does not offer may
2020 start school on any date permitted under Subsection (a) or the law
2121 of the other state.]
2222 SECTION 2. Section 7.056(e), Education Code, is amended to
2323 read as follows:
2424 (e) Except as provided by Subsection (f), a school campus or
2525 district may not receive an exemption or waiver under this section
2626 from:
2727 (1) a prohibition on conduct that constitutes a
2828 criminal offense;
2929 (2) a requirement imposed by federal law or rule,
3030 including a requirement for special education or bilingual
3131 education programs; or
3232 (3) a requirement, restriction, or prohibition
3333 relating to:
3434 (A) essential knowledge or skills under Section
3535 28.002 or minimum graduation requirements under Section 28.025;
3636 (B) public school accountability as provided by
3737 Subchapters B, C, D, and G, Chapter 39;
3838 (C) extracurricular activities under Section
3939 33.081 or participation in a University Interscholastic League
4040 area, regional, or state competition under Section 33.0812;
4141 (D) health and safety under Chapter 38;
4242 (E) purchasing under Subchapter B, Chapter 44;
4343 (F) elementary school class size limits, except
4444 as provided by Section 25.112;
4545 (G) removal of a disruptive student from the
4646 classroom under Subchapter A, Chapter 37;
4747 (H) at-risk programs under Subchapter C, Chapter
4848 29;
4949 (I) prekindergarten programs under Subchapter E,
5050 Chapter 29;
5151 (J) educator rights and benefits under
5252 Subchapters A, C, D, E, F, G, and I, Chapter 21, or under Subchapter
5353 A, Chapter 22;
5454 (K) special education programs under Subchapter
5555 A, Chapter 29; or
5656 (L) bilingual education programs under
5757 Subchapter B, Chapter 29[; or
5858 [(M) the requirements for the first day of
5959 instruction under Section 25.0811].
6060 SECTION 3. Section 25.084(a), Education Code, is amended to
6161 read as follows:
6262 (a) A school district may operate its schools year-round on
6363 either a single-track or a multitrack calendar. If a school
6464 district adopts a year-round system, the district may modify:
6565 (1) the number of contract days of employees and the
6666 number of days of operation, including any time required for staff
6767 development, planning and preparation, and continuing education,
6868 otherwise required by law;
6969 (2) testing dates, data reporting, and related
7070 matters; and
7171 (3) [the date of the first day of instruction of the
7272 school year under Section 25.0811 for a school that was operating
7373 year-round for the 2000-2001 school year; and
7474 [(4)] a student's eligibility to participate in
7575 extracurricular activities when the student's calendar track is not
7676 in session.
7777 SECTION 4. This Act applies beginning with the 2009-2010
7878 school year.
7979 SECTION 5. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2009.
