| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 25.0811, Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 25.0811. FIRST DAY OF INSTRUCTION. [(a)] The board of |
|---|
| 12 | 12 | | trustees of a [A] school district shall determine the first day of |
|---|
| 13 | 13 | | [may not begin] instruction for students [for a school year before |
|---|
| 14 | 14 | | the fourth Monday in August unless the district operates a |
|---|
| 15 | 15 | | year-round system under Section 25.084]. |
|---|
| 16 | 16 | | [(b) Notwithstanding Subsection (a), a school district that |
|---|
| 17 | 17 | | does not offer each grade level from kindergarten through grade 12 |
|---|
| 18 | 18 | | and whose prospective or former students generally attend school in |
|---|
| 19 | 19 | | another state for the grade levels the district does not offer may |
|---|
| 20 | 20 | | start school on any date permitted under Subsection (a) or the law |
|---|
| 21 | 21 | | of the other state.] |
|---|
| 22 | 22 | | SECTION 2. Section 7.056(e), Education Code, is amended to |
|---|
| 23 | 23 | | read as follows: |
|---|
| 24 | 24 | | (e) Except as provided by Subsection (f), a school campus or |
|---|
| 25 | 25 | | district may not receive an exemption or waiver under this section |
|---|
| 26 | 26 | | from: |
|---|
| 27 | 27 | | (1) a prohibition on conduct that constitutes a |
|---|
| 28 | 28 | | criminal offense; |
|---|
| 29 | 29 | | (2) a requirement imposed by federal law or rule, |
|---|
| 30 | 30 | | including a requirement for special education or bilingual |
|---|
| 31 | 31 | | education programs; or |
|---|
| 32 | 32 | | (3) a requirement, restriction, or prohibition |
|---|
| 33 | 33 | | relating to: |
|---|
| 34 | 34 | | (A) essential knowledge or skills under Section |
|---|
| 35 | 35 | | 28.002 or minimum graduation requirements under Section 28.025; |
|---|
| 36 | 36 | | (B) public school accountability as provided by |
|---|
| 37 | 37 | | Subchapters B, C, D, and G, Chapter 39; |
|---|
| 38 | 38 | | (C) extracurricular activities under Section |
|---|
| 39 | 39 | | 33.081 or participation in a University Interscholastic League |
|---|
| 40 | 40 | | area, regional, or state competition under Section 33.0812; |
|---|
| 41 | 41 | | (D) health and safety under Chapter 38; |
|---|
| 42 | 42 | | (E) purchasing under Subchapter B, Chapter 44; |
|---|
| 43 | 43 | | (F) elementary school class size limits, except |
|---|
| 44 | 44 | | as provided by Section 25.112; |
|---|
| 45 | 45 | | (G) removal of a disruptive student from the |
|---|
| 46 | 46 | | classroom under Subchapter A, Chapter 37; |
|---|
| 47 | 47 | | (H) at-risk programs under Subchapter C, Chapter |
|---|
| 48 | 48 | | 29; |
|---|
| 49 | 49 | | (I) prekindergarten programs under Subchapter E, |
|---|
| 50 | 50 | | Chapter 29; |
|---|
| 51 | 51 | | (J) educator rights and benefits under |
|---|
| 52 | 52 | | Subchapters A, C, D, E, F, G, and I, Chapter 21, or under Subchapter |
|---|

| 54 | 54 | | (K) special education programs under Subchapter |
|---|

|---|
| 56 | 56 | | (L) bilingual education programs under |
|---|

| 58 | 58 | | [(M) the requirements for the first day of |
|---|
| 59 | 59 | | instruction under Section 25.0811]. |

| 60 | 60 | | SECTION 3. Section 25.084(a), Education Code, is amended to |
|---|
| 61 | 61 | | read as follows: |
|---|
| 62 | 62 | | (a) A school district may operate its schools year-round on |
|---|
| 63 | 63 | | either a single-track or a multitrack calendar. If a school |
|---|
| 64 | 64 | | district adopts a year-round system, the district may modify: |
|---|
| 65 | 65 | | (1) the number of contract days of employees and the |
|---|
| 66 | 66 | | number of days of operation, including any time required for staff |
|---|
| 67 | 67 | | development, planning and preparation, and continuing education, |
|---|
| 68 | 68 | | otherwise required by law; |
|---|
| 69 | 69 | | (2) testing dates, data reporting, and related |
|---|
| 70 | 70 | | matters; and |
|---|
| 71 | 71 | | (3) [the date of the first day of instruction of the |
|---|
| 72 | 72 | | school year under Section 25.0811 for a school that was operating |
|---|
| 73 | 73 | | year-round for the 2000-2001 school year; and |
|---|
| 74 | 74 | | [(4)] a student's eligibility to participate in |
|---|
| 75 | 75 | | extracurricular activities when the student's calendar track is not |
|---|
| 76 | 76 | | in session. |
|---|
| 77 | 77 | | SECTION 4. This Act applies beginning with the 2009-2010 |
|---|
| 78 | 78 | | school year. |
|---|
| 79 | 79 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 80 | 80 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 81 | 81 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 82 | 82 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 83 | 83 | | Act takes effect September 1, 2009. |
