10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subtitle B, Title 4, Labor Code, is amended by |
---|
12 | 12 | | adding Chapter 312 to read as follows: |
---|
13 | 13 | | CHAPTER 312. TEXAS READY TO WORK CERTIFICATION PROGRAM |
---|
14 | 14 | | Sec. 312.001. DEFINITIONS. In this chapter: |
---|
15 | 15 | | (1) "Certification program" means the Texas Ready to |
---|
16 | 16 | | Work Certification Program established under this chapter. |
---|
17 | 17 | | (2) "Commission" means the Texas Workforce |
---|
18 | 18 | | Commission. |
---|
19 | 19 | | (3) "Program participant" means an individual |
---|
20 | 20 | | eligible under Section 312.002 to participate in the certification |
---|
21 | 21 | | program. |
---|
22 | 22 | | Sec. 312.002. CERTIFICATION PROGRAM. (a) The commission |
---|
23 | 23 | | shall develop and establish a certification program to provide job |
---|
24 | 24 | | skills training to: |
---|
25 | 25 | | (1) individuals receiving unemployment benefits under |
---|
26 | 26 | | Chapter 207; and |
---|
27 | 27 | | (2) individuals identified by the commission as |
---|
28 | 28 | | individuals who will soon enter the workforce. |
---|
29 | 29 | | (b) The commission shall: |
---|
30 | 30 | | (1) identify occupations appropriate for inclusion in |
---|
31 | 31 | | the certification program; and |
---|
32 | 32 | | (2) develop a set of basic skills for each included |
---|
33 | 33 | | occupation. |
---|
34 | 34 | | Sec. 312.003. CERTIFICATION PROGRAM ASSESSMENTS. (a) The |
---|
35 | 35 | | commission shall develop or adopt an assessment methodology to |
---|
36 | 36 | | determine a program participant's level of proficiency with each of |
---|
37 | 37 | | the skills identified under Section 312.002(b)(2). |
---|
38 | 38 | | (b) The commission shall determine appropriate facilities |
---|
39 | 39 | | and settings at which to conduct an assessment under this section. |
---|
40 | 40 | | Sec. 312.004. INSTRUCTIONAL CURRICULUM. (a) The |
---|
41 | 41 | | commission shall develop or adopt an instructional curriculum that |
---|
42 | 42 | | targets the skills in which a program participant is not |
---|
43 | 43 | | proficient, as measured by the assessment under Section 312.003. |
---|
44 | 44 | | (b) The commission shall provide Internet-based instruction |
---|
45 | 45 | | to assist each program participant in achieving proficiency in the |
---|
46 | 46 | | skills targeted under Subsection (a). |
---|
47 | 47 | | (c) After receiving instruction under Subsection (b), a |
---|
48 | 48 | | program participant may take a post-instructional assessment. |
---|
49 | 49 | | Sec. 312.005. CERTIFICATE; PORTFOLIO. The commission shall |
---|
50 | 50 | | provide to each program participant who successfully demonstrates |
---|
51 | 51 | | proficiency in the skills identified under Section 312.002(b)(2): |
---|
52 | 52 | | (1) a Texas Ready to Work certificate; and |
---|
53 | 53 | | (2) a portfolio that describes in detail each of the |
---|
54 | 54 | | skills in which the program participant is proficient as determined |
---|
55 | 55 | | by the post-instructional assessment under Section 312.004(c). |
---|
56 | 56 | | Sec. 312.006. RULEMAKING. The commission shall adopt rules |
---|
57 | 57 | | as necessary to administer the commission's duties under this |
---|
58 | 58 | | chapter. |
---|
59 | 59 | | Sec. 312.007. FUNDING. The commission is required to |
---|
60 | 60 | | implement this chapter only if the commission receives funds for |
---|
61 | 61 | | the purpose of establishing the certification program from: |
---|
62 | 62 | | (1) the American Recovery and Reinvestment Act of |
---|
63 | 63 | | 2009; |
---|
64 | 64 | | (2) a legislative appropriation; |
---|
65 | 65 | | (3) gifts, grants, or donations; or |
---|
66 | 66 | | (4) any other lawful source. |
---|
67 | 67 | | SECTION 2. This Act takes effect immediately if it receives |
---|
68 | 68 | | a vote of two-thirds of all the members elected to each house, as |
---|
69 | 69 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
70 | 70 | | Act does not receive the vote necessary for immediate effect, this |
---|
71 | 71 | | Act takes effect September 1, 2009. |
