1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle B, Title 4, Labor Code, is amended by
1212 adding Chapter 312 to read as follows:
1313 CHAPTER 312. TEXAS READY TO WORK CERTIFICATION PROGRAM
1414 Sec. 312.001. DEFINITIONS. In this chapter:
1515 (1) "Certification program" means the Texas Ready to
1616 Work Certification Program established under this chapter.
1717 (2) "Commission" means the Texas Workforce
1818 Commission.
1919 (3) "Program participant" means an individual
2020 eligible under Section 312.002 to participate in the certification
2121 program.
2222 Sec. 312.002. CERTIFICATION PROGRAM. (a) The commission
2323 shall develop and establish a certification program to provide job
2424 skills training to:
2525 (1) individuals receiving unemployment benefits under
2626 Chapter 207; and
2727 (2) individuals identified by the commission as
2828 individuals who will soon enter the workforce.
2929 (b) The commission shall:
3030 (1) identify occupations appropriate for inclusion in
3131 the certification program; and
3232 (2) develop a set of basic skills for each included
3333 occupation.
3434 Sec. 312.003. CERTIFICATION PROGRAM ASSESSMENTS. (a) The
3535 commission shall develop or adopt an assessment methodology to
3636 determine a program participant's level of proficiency with each of
3737 the skills identified under Section 312.002(b)(2).
3838 (b) The commission shall determine appropriate facilities
3939 and settings at which to conduct an assessment under this section.
4040 Sec. 312.004. INSTRUCTIONAL CURRICULUM. (a) The
4141 commission shall develop or adopt an instructional curriculum that
4242 targets the skills in which a program participant is not
4343 proficient, as measured by the assessment under Section 312.003.
4444 (b) The commission shall provide Internet-based instruction
4545 to assist each program participant in achieving proficiency in the
4646 skills targeted under Subsection (a).
4747 (c) After receiving instruction under Subsection (b), a
4848 program participant may take a post-instructional assessment.
4949 Sec. 312.005. CERTIFICATE; PORTFOLIO. The commission shall
5050 provide to each program participant who successfully demonstrates
5151 proficiency in the skills identified under Section 312.002(b)(2):
5252 (1) a Texas Ready to Work certificate; and
5353 (2) a portfolio that describes in detail each of the
5454 skills in which the program participant is proficient as determined
5555 by the post-instructional assessment under Section 312.004(c).
5656 Sec. 312.006. RULEMAKING. The commission shall adopt rules
5757 as necessary to administer the commission's duties under this
5858 chapter.
5959 Sec. 312.007. FUNDING. The commission is required to
6060 implement this chapter only if the commission receives funds for
6161 the purpose of establishing the certification program from:
6262 (1) the American Recovery and Reinvestment Act of
6363 2009;
6464 (2) a legislative appropriation;
6565 (3) gifts, grants, or donations; or
6666 (4) any other lawful source.
6767 SECTION 2. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2009.
