55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to disciplinary alternative education programs.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 37.008, Education Code, is amended by
1010 amending Subsections (a) and (a-1) and adding Subsections (a-2),
1111 (a-3), and (n) to read as follows:
1212 (a) Each school district shall provide a disciplinary
1313 alternative education program that:
1414 (1) is provided in a setting other than a student's
1515 regular classroom;
1616 (2) is located on or off of a regular school campus;
1717 (3) provides for the students who are assigned to the
1818 disciplinary alternative education program to be separated from
1919 students who are not assigned to the program;
2020 (4) focuses on English language arts, mathematics,
2121 science, history, and self-discipline;
2222 (5) provides for students' educational and behavioral
2323 needs, including a student's special education needs as provided
2424 under Subsection (a-2);
2525 (6) provides supervision and counseling;
2626 (7) employs:
2727 (A) only teachers who meet all certification
2828 requirements established under Subchapter B, Chapter 21; and
2929 (B) a sufficient number of teachers to maintain
3030 an average ratio of not less than one teacher for each 15 students
3131 placed in the district's program; and
3232 (8) provides not less than the minimum amount of
3333 instructional time per day required by Section 25.082(a).
3434 (a-1) The agency shall adopt minimum standards for the
3535 operation of disciplinary alternative education programs,
3636 including standards relating to:
3737 (1) [student/teacher ratios;
3838 [(2)] student health and safety;
3939 (2) [(3)] reporting of abuse, neglect, or
4040 exploitation of students; and
4141 (3) [(4)] training for teachers in behavior
4242 management and safety procedures[; and
4343 [(5) planning for a student's transition from a
4444 disciplinary alternative education program to a regular campus].
4545 (a-2) A disciplinary alternative education program must
4646 provide to a student participating in a school district's special
4747 education program educational services as necessary to support the
4848 student in meeting the goals identified in the student's
4949 individualized education program and in accordance with:
5050 (1) Subchapter A, Chapter 29;
5151 (2) Section 37.004; and
5252 (3) federal law.
5353 (a-3) Section 29.081 applies to a disciplinary alternative
5454 education program.
5555 (n) A school district shall establish transition procedures
5656 for a student who is returning from a disciplinary alternative
5757 education program to the student's regularly assigned education
5858 program. The procedures must provide for:
5959 (1) a timeline for the student's transition;
6060 (2) written and oral communication from each
6161 disciplinary alternative education program employee assigned to
6262 the student to each employee at the student's regularly assigned
6363 education program assigned to the student concerning the student's
6464 disciplinary alternative education program placement, including
6565 communication concerning the student's academic performance and
6666 assignments or other tasks completed; and
6767 (3) a written list of any actions taken during the
6868 student's disciplinary alternative education program placement to
6969 satisfy Section 29.081(a).
7070 SECTION 2. This Act applies beginning with the 2009-2010
7171 school year.
7272 SECTION 3. This Act takes effect immediately if it receives
7373 a vote of two-thirds of all the members elected to each house, as
7474 provided by Section 39, Article III, Texas Constitution. If this
7575 Act does not receive the vote necessary for immediate effect, this
7676 Act takes effect September 1, 2009.
