55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to exemptions from the sales tax for certain school
88 supplies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 151, Tax Code, is amended
1111 by adding Section 151.3275 to read as follows:
1212 Sec. 151.3275. SCHOOL SUPPLIES. (a) The sale or storage,
1313 use, or other consumption of a school supply is exempted from the
1414 taxes imposed by this chapter.
1515 (b) For purposes of this exemption, "school supply" means:
1616 (1) crayons;
1717 (2) scissors;
1818 (3) glue, paste, and glue sticks;
1919 (4) pencils;
2020 (5) pens;
2121 (6) erasers;
2222 (7) rulers;
2323 (8) markers;
2424 (9) highlighters;
2525 (10) paper, including loose-leaf ruled notebook
2626 paper, copy paper, graph paper, tracing paper, manila paper,
2727 colored paper, poster board, and construction paper;
2828 (11) writing tablets;
2929 (12) spiral notebooks;
3030 (13) bound composition notebooks;
3131 (14) pocket folders;
3232 (15) plastic folders;
3333 (16) expandable portfolios;
3434 (17) manila folders;
3535 (18) three-ring binders that are three inches or less
3636 in capacity;
3737 (19) backpacks and zipper pencil bags;
3838 (20) school supply boxes;
3939 (21) clipboards;
4040 (22) index cards;
4141 (23) index card boxes;
4242 (24) calculators;
4343 (25) protractors;
4444 (26) compasses;
4545 (27) music notebooks;
4646 (28) sketch or drawing pads;
4747 (29) paintbrushes;
4848 (30) watercolors;
4949 (31) acrylic, tempera, or oil paints;
5050 (32) tape, including masking tape and Scotch tape;
5151 (33) clay and glazes;
5252 (34) pencil sharpeners;
5353 (35) thesauruses; and
5454 (36) dictionaries.
5555 SECTION 2. Section 151.327, Tax Code, is repealed.
5656 SECTION 3. The change in law made by this Act does not
5757 affect taxes imposed before the effective date of this Act, and the
5858 law in effect before the effective date of this Act is continued in
5959 effect for purposes of the liability for and collection of those
6060 taxes.
6161 SECTION 4. This Act takes effect July 1, 2009, if it
6262 receives a vote of two-thirds of all the members elected to each
6363 house, as provided by Section 39, Article III, Texas Constitution.
6464 If this Act does not receive the vote necessary for effect on that
6565 date, this Act takes effect October 1, 2009.
