| 7 | 7 | | relating to applicability of fee exemptions for military personnel |

| 8 | 8 | | and their children to certain course fees charged by public |
|---|
| 9 | 9 | | technical institutes and public state colleges. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 54.203(g), Education Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (g) The governing board of a public junior college, public |
|---|
| 14 | 14 | | technical institute, or public state college, as those terms are |
|---|
| 15 | 15 | | defined by Section 61.003, [district] may establish a fee for |
|---|
| 16 | 16 | | extraordinary costs associated with a specific course or program |
|---|
| 17 | 17 | | and may provide that the exemptions provided by Subsections (a) and |
|---|
| 18 | 18 | | (b) do not apply to this fee. |

| 19 | 19 | | SECTION 2. Section 54.203, Education Code, as amended by |
|---|
| 20 | 20 | | this Act, applies beginning with fees charged for the 2009 fall |
|---|
| 21 | 21 | | semester. Fees charged for an academic period before that semester |
|---|
| 22 | 22 | | are covered by the law in effect immediately before the effective |
|---|
| 23 | 23 | | date of this Act, and the former law is continued in effect for that |
|---|
| 24 | 24 | | purpose. |

| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
