55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the requirement that a seller of regulated material to a
88 metal recycling entity present evidence of an occupational license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1956.001, Occupations Code, is amended
1111 by adding Subdivision (7-a) to read as follows:
1212 (7-a) "Occupational license" means a license,
1313 certificate, registration, permit, or other form of authorization
1414 required by law or rule that must be obtained by an individual to
1515 engage in a particular business or occupation.
1616 SECTION 2. Section 1956.032(a), Occupations Code, is
1717 amended to read as follows:
1818 (a) Except as provided by Subsection (f), a person
1919 attempting to sell regulated material to a metal recycling entity
2020 shall:
2121 (1) display to the metal recycling entity the person's
2222 personal identification document;
2323 (2) provide to the metal recycling entity the make,
2424 model, and license plate number of the motor vehicle used to
2525 transport the regulated material; [and]
2626 (3) either:
2727 (A) present written documentation evidencing
2828 that the person is the legal owner or is lawfully entitled to sell
2929 the regulated material; or
3030 (B) sign a written statement provided by the
3131 metal recycling entity that the person is the legal owner of or is
3232 lawfully entitled to sell the regulated material offered for sale;
3333 and
3434 (4) display to the metal recycling entity the person's
3535 occupational license or, if the person does not have an
3636 occupational license, the occupational license of the person's
3737 employer.
3838 SECTION 3. Section 1956.033(b), Occupations Code, is
3939 amended to read as follows:
4040 (b) The record must be in English and include:
4141 (1) the place and date of the purchase;
4242 (2) the name and address of each individual from whom
4343 the regulated material is purchased or obtained;
4444 (3) the identifying number of the seller's personal
4545 identification document and of the occupational license presented
4646 by the seller;
4747 (4) a description made in accordance with the custom
4848 of the trade of the type and quantity of regulated material
4949 purchased; and
5050 (5) the information required by Section
5151 1956.032(a)(3).
5252 SECTION 4. This Act takes effect September 1, 2009.
