66 AN ACT
77 relating to the requirement that an applicant for registration of a
88 vehicle provide proof that the vehicle has passed a compulsory
99 vehicle inspection.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 502.1535, Transportation Code, is
1212 amended to read as follows:
1313 Sec. 502.1535. EVIDENCE OF VEHICLE OR VEHICLE EMISSIONS
1414 INSPECTION. (a) A county assessor-collector may not register a
1515 vehicle subject to Section 548.051 unless proof that the vehicle
1616 has passed an inspection as required by that section, in a form
1717 authorized by that section, is presented to the county
1818 assessor-collector with the application for registration.
1919 (b) A county assessor-collector may not register a motor
2020 vehicle subject to Section 548.3011 unless proof that the vehicle
2121 has passed a vehicle emissions test as required by that section, in
2222 a form authorized by that section, is presented to the county
2323 assessor-collector with the application for registration.
2424 SECTION 2. Section 548.051, Transportation Code, is amended
2525 by adding Subsection (c) to read as follows:
2626 (c) A vehicle subject to this section is not eligible for
2727 registration under Chapter 502 unless proof is presented with the
2828 application for registration that the vehicle has passed the
2929 inspection required by this section. The proof required by this
3030 subsection may be in the form of a Vehicle Inspection Report (VIR)
3131 or other proof of inspection as authorized by the department. A
3232 Vehicle Inspection Report or other authorized proof of inspection
3333 must include, in type larger than other type on the Vehicle
3434 Inspection Report or other proof of inspection, the following
3535 statement:
3636 "A motor vehicle may not be registered in this state on or
3737 after September 1, 2010, unless the applicant for registration
3838 provides proof that the vehicle has passed the inspection required
3939 by law. This document, or a copy of this document, is acceptable
4040 proof that the vehicle has passed such an inspection."
4141 SECTION 3. (a) Except as provided by Subsection (b) of this
4242 section, this Act takes effect September 1, 2009.
4343 (b) Section 502.1535(a), Transportation Code, as added by
4444 this Act, takes effect September 1, 2010.
