| 7 | 7 | | relating to the requirement that an applicant for registration of a |

| 8 | 8 | | vehicle provide proof that the vehicle has passed a compulsory |
|---|
| 9 | 9 | | vehicle inspection. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 502.1535, Transportation Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | Sec. 502.1535. EVIDENCE OF VEHICLE OR VEHICLE EMISSIONS |
|---|
| 14 | 14 | | INSPECTION. (a) A county assessor-collector may not register a |
|---|
| 15 | 15 | | vehicle subject to Section 548.051 unless proof that the vehicle |
|---|
| 16 | 16 | | has passed an inspection as required by that section, in a form |
|---|
| 17 | 17 | | authorized by that section, is presented to the county |
|---|
| 18 | 18 | | assessor-collector with the application for registration. |
|---|
| 19 | 19 | | (b) A county assessor-collector may not register a motor |
|---|
| 20 | 20 | | vehicle subject to Section 548.3011 unless proof that the vehicle |
|---|
| 21 | 21 | | has passed a vehicle emissions test as required by that section, in |
|---|
| 22 | 22 | | a form authorized by that section, is presented to the county |
|---|
| 23 | 23 | | assessor-collector with the application for registration. |
|---|
| 24 | 24 | | SECTION 2. Section 548.051, Transportation Code, is amended |
|---|
| 25 | 25 | | by adding Subsection (c) to read as follows: |
|---|
| 26 | 26 | | (c) A vehicle subject to this section is not eligible for |
|---|
| 27 | 27 | | registration under Chapter 502 unless proof is presented with the |
|---|
| 28 | 28 | | application for registration that the vehicle has passed the |
|---|
| 29 | 29 | | inspection required by this section. The proof required by this |
|---|
| 30 | 30 | | subsection may be in the form of a Vehicle Inspection Report (VIR) |
|---|
| 31 | 31 | | or other proof of inspection as authorized by the department. A |
|---|
| 32 | 32 | | Vehicle Inspection Report or other authorized proof of inspection |
|---|
| 33 | 33 | | must include, in type larger than other type on the Vehicle |
|---|
| 34 | 34 | | Inspection Report or other proof of inspection, the following |
|---|
| 35 | 35 | | statement: |
|---|
| 36 | 36 | | "A motor vehicle may not be registered in this state on or |
|---|
| 37 | 37 | | after September 1, 2010, unless the applicant for registration |
|---|
| 38 | 38 | | provides proof that the vehicle has passed the inspection required |
|---|
| 39 | 39 | | by law. This document, or a copy of this document, is acceptable |
|---|
| 40 | 40 | | proof that the vehicle has passed such an inspection." |
|---|
| 41 | 41 | | SECTION 3. (a) Except as provided by Subsection (b) of this |
|---|
| 42 | 42 | | section, this Act takes effect September 1, 2009. |
|---|
| 43 | 43 | | (b) Section 502.1535(a), Transportation Code, as added by |
|---|
| 44 | 44 | | this Act, takes effect September 1, 2010. |
