66 AN ACT
77 relating to the revision of building energy efficiency performance
88 standards.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 388, Health and Safety Code, is amended
1111 by adding Section 388.0035 to read as follows:
1212 Sec. 388.0035. REVISION OF STANDARDS. (a) At least once
1313 every five years, the State Energy Conservation Office shall
1414 review:
1515 (1) revisions made by the International Code Council
1616 to the International Energy Conservation Code and the energy
1717 efficiency chapter of the International Residential Code after May
1818 1, 2001; and
1919 (2) local amendments made to the codes or energy
2020 efficiency programs that have strengthened energy efficiency
2121 requirements.
2222 (b) The review must be conducted in consultation with the
2323 laboratory and an advisory committee established by the State
2424 Energy Conservation Office.
2525 (c) The State Energy Conservation Office by rule shall
2626 establish a procedure for persons who have an interest in the
2727 adoption of standards for energy efficiency under Sections
2828 388.003(a) and (b) to have an opportunity to comment on the
2929 standards under consideration. The office shall consider persons
3030 who have an interest in adoption of standards to include:
3131 (1) commercial and residential builders, architects,
3232 and engineers;
3333 (2) municipal, county, and other local governmental
3434 authorities; and
3535 (3) environmental groups.
3636 (d) Following the completion of the review, the State Energy
3737 Conservation Office by rule shall adopt revised standards for
3838 energy efficiency to replace the standards under Sections
3939 388.003(a) and (b).
4040 (e) The revised standards must result in reducing either
4141 projected annual or ozone season energy consumption in new
4242 buildings by a minimum of 15 percent compared to the standards being
4343 used at the time of the review.
4444 (f) To achieve the goal of adopting standards by January 1,
4545 2030, that will result in residential construction designed to
4646 consume no more energy on a net annual basis than can be produced
4747 on-site from renewable energy sources, the State Energy
4848 Conservation Office and the advisory committee shall, not later
4949 than January 1, 2011:
5050 (1) conduct a study on the feasibility of reaching
5151 that goal; and
5252 (2) make recommendations to the legislature on a
5353 schedule for adopting progressive standards to reach that goal.
5454 SECTION 2. The following sections are repealed:
5555 (1) Sections 388.003(b-1) and (b-2), Health and Safety
5656 Code, as added by Section 3.01, Chapter 262 (S.B. 12), and Section
5757 11, Chapter 939 (H.B. 3693), Acts of the 80th Legislature, Regular
5858 Session, 2007; and
5959 (2) Section 388.003(b-3), Health and Safety Code.
6060 SECTION 3. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2009.
