7 | 7 | | relating to the revision of building energy efficiency performance |
---|
8 | 8 | | standards. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Chapter 388, Health and Safety Code, is amended |
---|
11 | 11 | | by adding Section 388.0035 to read as follows: |
---|
12 | 12 | | Sec. 388.0035. REVISION OF STANDARDS. (a) At least once |
---|
13 | 13 | | every five years, the State Energy Conservation Office shall |
---|
14 | 14 | | review: |
---|
15 | 15 | | (1) revisions made by the International Code Council |
---|
16 | 16 | | to the International Energy Conservation Code and the energy |
---|
17 | 17 | | efficiency chapter of the International Residential Code after May |
---|
18 | 18 | | 1, 2001; and |
---|
19 | 19 | | (2) local amendments made to the codes or energy |
---|
20 | 20 | | efficiency programs that have strengthened energy efficiency |
---|
21 | 21 | | requirements. |
---|
22 | 22 | | (b) The review must be conducted in consultation with the |
---|
23 | 23 | | laboratory and an advisory committee established by the State |
---|
24 | 24 | | Energy Conservation Office. |
---|
25 | 25 | | (c) The State Energy Conservation Office by rule shall |
---|
26 | 26 | | establish a procedure for persons who have an interest in the |
---|
27 | 27 | | adoption of standards for energy efficiency under Sections |
---|
28 | 28 | | 388.003(a) and (b) to have an opportunity to comment on the |
---|
29 | 29 | | standards under consideration. The office shall consider persons |
---|
30 | 30 | | who have an interest in adoption of standards to include: |
---|
31 | 31 | | (1) commercial and residential builders, architects, |
---|
32 | 32 | | and engineers; |
---|
33 | 33 | | (2) municipal, county, and other local governmental |
---|
34 | 34 | | authorities; and |
---|
35 | 35 | | (3) environmental groups. |
---|
36 | 36 | | (d) Following the completion of the review, the State Energy |
---|
37 | 37 | | Conservation Office by rule shall adopt revised standards for |
---|
38 | 38 | | energy efficiency to replace the standards under Sections |
---|
39 | 39 | | 388.003(a) and (b). |
---|
40 | 40 | | (e) The revised standards must result in reducing either |
---|
41 | 41 | | projected annual or ozone season energy consumption in new |
---|
42 | 42 | | buildings by a minimum of 15 percent compared to the standards being |
---|
43 | 43 | | used at the time of the review. |
---|
44 | 44 | | (f) To achieve the goal of adopting standards by January 1, |
---|
45 | 45 | | 2030, that will result in residential construction designed to |
---|
46 | 46 | | consume no more energy on a net annual basis than can be produced |
---|
47 | 47 | | on-site from renewable energy sources, the State Energy |
---|
48 | 48 | | Conservation Office and the advisory committee shall, not later |
---|
49 | 49 | | than January 1, 2011: |
---|
50 | 50 | | (1) conduct a study on the feasibility of reaching |
---|
51 | 51 | | that goal; and |
---|
52 | 52 | | (2) make recommendations to the legislature on a |
---|
53 | 53 | | schedule for adopting progressive standards to reach that goal. |
---|
54 | 54 | | SECTION 2. The following sections are repealed: |
---|
55 | 55 | | (1) Sections 388.003(b-1) and (b-2), Health and Safety |
---|
56 | 56 | | Code, as added by Section 3.01, Chapter 262 (S.B. 12), and Section |
---|
57 | 57 | | 11, Chapter 939 (H.B. 3693), Acts of the 80th Legislature, Regular |
---|
58 | 58 | | Session, 2007; and |
---|
59 | 59 | | (2) Section 388.003(b-3), Health and Safety Code. |
---|
60 | 60 | | SECTION 3. This Act takes effect immediately if it receives |
---|
61 | 61 | | a vote of two-thirds of all the members elected to each house, as |
---|
62 | 62 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
63 | 63 | | Act does not receive the vote necessary for immediate effect, this |
---|
64 | 64 | | Act takes effect September 1, 2009. |
---|
