| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 827.001, Insurance Code, is amended by |
|---|
| 10 | 10 | | adding Subdivision (3) to read as follows: |
|---|
| 11 | 11 | | (3) "Personal automobile insurance" and "residential |
|---|
| 12 | 12 | | property insurance" have the meanings assigned by Section 2254.001. |
|---|
| 13 | 13 | | SECTION 2. Section 827.006, Insurance Code, is amended to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | Sec. 827.006. [RESUMPTION OF] WRITING INSURANCE AFTER |
|---|
| 16 | 16 | | COMPLETE WITHDRAWAL. An insurer that withdraws from writing |
|---|
| 17 | 17 | | residential property insurance or personal automobile [all lines |
|---|
| 18 | 18 | | of] insurance in this state may not write any line of [, without the |
|---|
| 19 | 19 | | approval of the commissioner, resume writing] insurance in this |
|---|
| 20 | 20 | | state before the fifth anniversary of the date of withdrawal unless |
|---|
| 21 | 21 | | the commissioner approves the insurer to write a particular line of |
|---|
| 22 | 22 | | insurance after determining that the line of insurance is not |
|---|
| 23 | 23 | | available to a substantial number of policyholders or potential |
|---|
| 24 | 24 | | policyholders in a rating territory in this state at an affordable |
|---|
| 25 | 25 | | rate. |
|---|
| 26 | 26 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 27 | 27 | | to a withdrawal plan filed with the Texas Department of Insurance on |
|---|
| 28 | 28 | | or after the effective date of this Act. A withdrawal plan filed |
|---|
| 29 | 29 | | with the Texas Department of Insurance before the effective date of |
|---|
| 30 | 30 | | this Act is covered by the law in effect at the time the withdrawal |
|---|
| 31 | 31 | | plan was filed, and that law is continued in effect for that |
|---|
| 32 | 32 | | purpose. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect September 1, 2009. |
