66 AN ACT
77 relating to withdrawal plans for certain insurers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 827.001, Insurance Code, is amended by
1010 adding Subdivision (3) to read as follows:
1111 (3) "Personal automobile insurance" and "residential
1212 property insurance" have the meanings assigned by Section 2254.001.
1313 SECTION 2. Section 827.006, Insurance Code, is amended to
1414 read as follows:
1515 Sec. 827.006. [RESUMPTION OF] WRITING INSURANCE AFTER
1616 COMPLETE WITHDRAWAL. An insurer that withdraws from writing
1717 residential property insurance or personal automobile [all lines
1818 of] insurance in this state may not write any line of [, without the
1919 approval of the commissioner, resume writing] insurance in this
2020 state before the fifth anniversary of the date of withdrawal unless
2121 the commissioner approves the insurer to write a particular line of
2222 insurance after determining that the line of insurance is not
2323 available to a substantial number of policyholders or potential
2424 policyholders in a rating territory in this state at an affordable
2525 rate.
2626 SECTION 3. The change in law made by this Act applies only
2727 to a withdrawal plan filed with the Texas Department of Insurance on
2828 or after the effective date of this Act. A withdrawal plan filed
2929 with the Texas Department of Insurance before the effective date of
3030 this Act is covered by the law in effect at the time the withdrawal
3131 plan was filed, and that law is continued in effect for that
3232 purpose.
3333 SECTION 4. This Act takes effect September 1, 2009.
