66 AN ACT
77 relating to liability of charitable organizations for certain
88 negligent hiring, supervision, or retention actions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 84.007, Civil Practice and Remedies
1111 Code, is amended by adding Subsection (i) to read as follows:
1212 (i) This chapter does not limit the liability of a
1313 charitable organization organized exclusively for religious,
1414 charitable, educational, or hospital purposes for the negligent
1515 hiring, supervision, or retention of an employee, agent, or servant
1616 of the organization that results in a sexual offense being
1717 committed against a person younger than 18 years of age who receives
1818 benefits or services from the organization. For the purposes of
1919 this subsection, "sexual offense" means an offense under Chapter
2020 21, Penal Code.
2121 SECTION 2. The change in law made by this Act applies to an
2222 action that is pending or commenced on or after the effective date
2323 of this Act.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2009.
