| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 84.007, Civil Practice and Remedies |
|---|
| 11 | 11 | | Code, is amended by adding Subsection (i) to read as follows: |
|---|
| 12 | 12 | | (i) This chapter does not limit the liability of a |
|---|
| 13 | 13 | | charitable organization organized exclusively for religious, |
|---|
| 14 | 14 | | charitable, educational, or hospital purposes for the negligent |
|---|
| 15 | 15 | | hiring, supervision, or retention of an employee, agent, or servant |
|---|
| 16 | 16 | | of the organization that results in a sexual offense being |
|---|
| 17 | 17 | | committed against a person younger than 18 years of age who receives |
|---|
| 18 | 18 | | benefits or services from the organization. For the purposes of |
|---|
| 19 | 19 | | this subsection, "sexual offense" means an offense under Chapter |
|---|
| 20 | 20 | | 21, Penal Code. |
|---|
| 21 | 21 | | SECTION 2. The change in law made by this Act applies to an |
|---|
| 22 | 22 | | action that is pending or commenced on or after the effective date |
|---|
| 23 | 23 | | of this Act. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2009. |
