77 relating to consumer goods and services covered under the Texas
88 Telemarketing Disclosure and Privacy Act.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 304.002(3), Business & Commerce Code, as
1111 effective April 1, 2009, is amended to read as follows:
1212 (3) "Consumer good or service" means property of any
1313 kind or a contractual service that is normally used for personal,
1414 family, or household purposes. The term:
1515 (A) does not include a security, as defined by
1616 Section 4, The Securities Act (Article 581-4, Vernon's Texas Civil
1717 Statutes); and
1818 (B) includes the extension of a warranty for a
1919 motor vehicle.
2020 SECTION 2. The change in law made by this Act applies only
2121 to a call made on or after the effective date of this Act. A call
2222 made before the effective date of this Act is governed by the law in
2323 effect when the call was made, and the former law is continued in
2424 effect for that purpose.
2525 SECTION 3. This Act takes effect September 1, 2009.
