66 AN ACT
77 relating to information provided by an entity authorized to
88 commission, appoint, or employ law enforcement officers upon
99 creation of a law enforcement agency or a police department.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 1701, Occupations Code, is
1212 amended by adding Section 1701.162 to read as follows:
1313 Sec. 1701.162. INFORMATION PROVIDED BY COMMISSIONING
1414 ENTITIES. (a) This section applies only to an entity authorized by
1515 statute or by the constitution to create a law enforcement agency or
1616 police department and commission, appoint, or employ officers that
1717 first creates a law enforcement agency or police department and
1818 first begins to commission, appoint, or employ officers on or after
1919 September 1, 2009.
2020 (b) The entity shall submit to the commission on creation of
2121 the law enforcement agency or police department information
2222 regarding:
2323 (1) the need for the law enforcement agency or police
2424 department in the community;
2525 (2) the funding sources for the law enforcement agency
2626 or police department;
2727 (3) the physical resources available to officers;
2828 (4) the physical facilities which the law enforcement
2929 agency or police department will operate, including descriptions of
3030 the evidence room, dispatch area, and public area;
3131 (5) law enforcement policies of the law enforcement
3232 agency or police department, including policies on:
3333 (A) use of force;
3434 (B) vehicle pursuit;
3535 (C) professional conduct of officers;
3636 (D) domestic abuse protocols;
3737 (E) response to missing persons;
3838 (F) supervision of part-time officers; and
3939 (G) impartial policing;
4040 (6) the administrative structure of the law
4141 enforcement agency or police department;
4242 (7) liability insurance; and
4343 (8) any other information the commission requires by
4444 rule.
4545 SECTION 2. This Act takes effect September 1, 2009.
