| 8 | 8 | | commission, appoint, or employ law enforcement officers upon |
|---|
| 9 | 9 | | creation of a law enforcement agency or a police department. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 1701, Occupations Code, is |
|---|
| 12 | 12 | | amended by adding Section 1701.162 to read as follows: |
|---|
| 13 | 13 | | Sec. 1701.162. INFORMATION PROVIDED BY COMMISSIONING |
|---|
| 14 | 14 | | ENTITIES. (a) This section applies only to an entity authorized by |
|---|
| 15 | 15 | | statute or by the constitution to create a law enforcement agency or |
|---|
| 16 | 16 | | police department and commission, appoint, or employ officers that |
|---|
| 17 | 17 | | first creates a law enforcement agency or police department and |
|---|
| 18 | 18 | | first begins to commission, appoint, or employ officers on or after |
|---|
| 19 | 19 | | September 1, 2009. |
|---|
| 20 | 20 | | (b) The entity shall submit to the commission on creation of |
|---|
| 21 | 21 | | the law enforcement agency or police department information |
|---|
| 22 | 22 | | regarding: |
|---|
| 23 | 23 | | (1) the need for the law enforcement agency or police |
|---|
| 24 | 24 | | department in the community; |
|---|
| 25 | 25 | | (2) the funding sources for the law enforcement agency |
|---|
| 26 | 26 | | or police department; |
|---|
| 27 | 27 | | (3) the physical resources available to officers; |
|---|
| 28 | 28 | | (4) the physical facilities which the law enforcement |
|---|
| 29 | 29 | | agency or police department will operate, including descriptions of |
|---|
| 30 | 30 | | the evidence room, dispatch area, and public area; |
|---|
| 31 | 31 | | (5) law enforcement policies of the law enforcement |
|---|
| 32 | 32 | | agency or police department, including policies on: |
|---|
| 33 | 33 | | (A) use of force; |
|---|
| 34 | 34 | | (B) vehicle pursuit; |
|---|
| 35 | 35 | | (C) professional conduct of officers; |
|---|
| 36 | 36 | | (D) domestic abuse protocols; |
|---|
| 37 | 37 | | (E) response to missing persons; |
|---|
| 38 | 38 | | (F) supervision of part-time officers; and |
|---|
| 39 | 39 | | (G) impartial policing; |
|---|
| 40 | 40 | | (6) the administrative structure of the law |
|---|
| 41 | 41 | | enforcement agency or police department; |
|---|
| 42 | 42 | | (7) liability insurance; and |
|---|
| 43 | 43 | | (8) any other information the commission requires by |
|---|
| 44 | 44 | | rule. |
|---|
| 45 | 45 | | SECTION 2. This Act takes effect September 1, 2009. |
