55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the water pressure standards for fire hydrants in
88 certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 341.0357(b), (c), (d), (e), and (f),
1111 Health and Safety Code, as added by Chapter 861 (H.B. 1391), Acts of
1212 the 80th Legislature, Regular Session, 2007, are amended to read as
1313 follows:
1414 (b) The regulatory authority for a public utility shall by
1515 rule or ordinance adopt standards for maintaining sufficient water
1616 pressure for service to fire hydrants adequate to protect public
1717 safety in residential areas in a municipality with a population of
1818 10,000 [1,000,000] or more.
1919 (c) The commission shall assess residential areas in a
2020 municipality with a population of 10,000 [1,000,000] or more to
2121 ensure that:
2222 (1) the regulatory authority for the area has adopted
2323 the standards required by this section; and
2424 (2) all public utilities serving the residential area
2525 are complying with the standards required by this section.
2626 (d) The commission shall require a municipality with a
2727 population of 10,000 [1,000,000] or more and acting as a regulatory
2828 authority to make appropriate revisions to standards the commission
2929 considers to be inadequate within a reasonable time established by
3030 the commission.
3131 (e) The commission shall require a public utility in
3232 violation of a standard required under this section and established
3333 by the commission or by a municipality with a population of 10,000
3434 [1,000,000] or more and acting as a regulatory authority to comply
3535 with the standard within a reasonable time established by the
3636 commission.
3737 (f) This section does not limit the authority of a
3838 municipality with a population of 10,000 [1,000,000] or more and
3939 acting as a regulatory authority to prohibit a public utility in
4040 violation of a standard established by the municipality from
4141 recovering through the public utility's rates a penalty or fine
4242 incurred for a violation of a standard.
4343 SECTION 2. This Act takes effect September 1, 2009.
