| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 659.1031(b), Government Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (b) In this section, "eligible state employee organization" | |
| 13 | 13 | means a state employee organization with a membership of at least | |
| 14 | 14 | 2,000 active or retired state employees who: | |
| 15 | 15 | (1) hold or who have held certification from the | |
| 16 | 16 | Commission on Law Enforcement Officer Standards and Education; or | |
| 17 | 17 | (2) are employed or have been employed by the Texas | |
| 18 | 18 | Department of Criminal Justice. | |
| 19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2009. |
