7 | 7 | | relating to eligible recipients of certain grants awarded by the |
---|
8 | 8 | | commissioner of education. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 29.917, Education Code, is amended by |
---|
11 | 11 | | amending Subsection (a) and adding Subsection (d) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (a) From funds appropriated for the purpose, the |
---|
14 | 14 | | commissioner may award grants to organizations that provide |
---|
15 | 15 | | volunteers to teach classroom or after-school programs to students |
---|
16 | 16 | | enrolled in a school district or open-enrollment charter school to |
---|
17 | 17 | | enhance: |
---|
18 | 18 | | (1) college readiness; |
---|
19 | 19 | | (2) workforce readiness; |
---|
20 | 20 | | (3) dropout prevention; or |
---|
21 | 21 | | (4) personal financial literacy. |
---|
22 | 22 | | (d) This section does not authorize the commissioner to |
---|
23 | 23 | | award a grant to an organization to provide a comprehensive |
---|
24 | 24 | | educational program to students that serves as a substitute for a |
---|
25 | 25 | | regular educational program provided by a school district or |
---|
26 | 26 | | open-enrollment charter school. This section authorizes the |
---|
27 | 27 | | commissioner to award a grant to an organization only for the |
---|
28 | 28 | | provision of supplemental programs described by Subsection (a). |
---|
29 | 29 | | SECTION 2. Section 39.361(c), Education Code, is amended to |
---|
30 | 30 | | read as follows: |
---|
31 | 31 | | (c) To meet the goals of the council's strategic plan, the |
---|
32 | 32 | | [The] commissioner of education or the commissioner of higher |
---|
33 | 33 | | education, as applicable, shall consider the council's |
---|
34 | 34 | | recommendations and based on those recommendations may award grants |
---|
35 | 35 | | listed in Subsection (a) to school districts, open-enrollment |
---|
36 | 36 | | charter schools, institutions of higher education, regional |
---|
37 | 37 | | education service centers, and nonprofit organizations that |
---|
38 | 38 | | provide technical assistance, professional development, |
---|
39 | 39 | | case-managed student services, and programs for the benefit of |
---|
40 | 40 | | students enrolled in school districts or open-enrollment charter |
---|
41 | 41 | | schools [to meet the goals of the council's strategic plan]. |
---|
42 | 42 | | SECTION 3. Subchapter L, Chapter 39, Education Code, is |
---|
43 | 43 | | amended by adding Section 39.367 to read as follows: |
---|
44 | 44 | | Sec. 39.367. CERTAIN GRANTS TO NONPROFIT ORGANIZATIONS NOT |
---|
45 | 45 | | AUTHORIZED. This subchapter does not authorize the commissioner to |
---|
46 | 46 | | award a grant to a nonprofit organization for services provided as a |
---|
47 | 47 | | private school or to a private school. |
---|
48 | 48 | | SECTION 4. It is the intent of the legislature that the |
---|
49 | 49 | | grants that may not be awarded to an organization or nonprofit |
---|
50 | 50 | | organization under Sections 29.917(d) and 39.367, Education Code, |
---|
51 | 51 | | as added by this Act, include dropout recovery grants, such as the |
---|
52 | 52 | | grants awarded in 2008 in response to the Texas Education Agency's |
---|
53 | 53 | | Request for Applications (RFA) 701-08-116. |
---|
54 | 54 | | SECTION 5. This Act takes effect immediately if it receives |
---|
55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 58 | | Act takes effect September 1, 2009. |
