66 AN ACT
77 relating to eligible recipients of certain grants awarded by the
88 commissioner of education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.917, Education Code, is amended by
1111 amending Subsection (a) and adding Subsection (d) to read as
1212 follows:
1313 (a) From funds appropriated for the purpose, the
1414 commissioner may award grants to organizations that provide
1515 volunteers to teach classroom or after-school programs to students
1616 enrolled in a school district or open-enrollment charter school to
1717 enhance:
1818 (1) college readiness;
1919 (2) workforce readiness;
2020 (3) dropout prevention; or
2121 (4) personal financial literacy.
2222 (d) This section does not authorize the commissioner to
2323 award a grant to an organization to provide a comprehensive
2424 educational program to students that serves as a substitute for a
2525 regular educational program provided by a school district or
2626 open-enrollment charter school. This section authorizes the
2727 commissioner to award a grant to an organization only for the
2828 provision of supplemental programs described by Subsection (a).
2929 SECTION 2. Section 39.361(c), Education Code, is amended to
3030 read as follows:
3131 (c) To meet the goals of the council's strategic plan, the
3232 [The] commissioner of education or the commissioner of higher
3333 education, as applicable, shall consider the council's
3434 recommendations and based on those recommendations may award grants
3535 listed in Subsection (a) to school districts, open-enrollment
3636 charter schools, institutions of higher education, regional
3737 education service centers, and nonprofit organizations that
3838 provide technical assistance, professional development,
3939 case-managed student services, and programs for the benefit of
4040 students enrolled in school districts or open-enrollment charter
4141 schools [to meet the goals of the council's strategic plan].
4242 SECTION 3. Subchapter L, Chapter 39, Education Code, is
4343 amended by adding Section 39.367 to read as follows:
4444 Sec. 39.367. CERTAIN GRANTS TO NONPROFIT ORGANIZATIONS NOT
4545 AUTHORIZED. This subchapter does not authorize the commissioner to
4646 award a grant to a nonprofit organization for services provided as a
4747 private school or to a private school.
4848 SECTION 4. It is the intent of the legislature that the
4949 grants that may not be awarded to an organization or nonprofit
5050 organization under Sections 29.917(d) and 39.367, Education Code,
5151 as added by this Act, include dropout recovery grants, such as the
5252 grants awarded in 2008 in response to the Texas Education Agency's
5353 Request for Applications (RFA) 701-08-116.
5454 SECTION 5. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2009.
