| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 21.12(a), Penal Code, is amended to read | |
| 11 | 11 | as follows: | |
| 12 | 12 | (a) An employee of a public or private primary or secondary | |
| 13 | 13 | school commits an offense if the employee engages in: | |
| 14 | 14 | (1) sexual contact, sexual intercourse, or deviate | |
| 15 | 15 | sexual intercourse with a person who is enrolled in a public or | |
| 16 | 16 | private primary or secondary school [at which the employee works] | |
| 17 | 17 | and [who] is not the employee's spouse; or | |
| 18 | 18 | (2) conduct described by Section 33.021, with a person | |
| 19 | 19 | described by Subdivision (1), regardless of the age of that person. | |
| 20 | 20 | SECTION 2. The change in law made by this Act applies only | |
| 21 | 21 | to an offense committed on or after the effective date of this Act. | |
| 22 | 22 | An offense committed before the effective date of this Act is | |
| 23 | 23 | covered by the law in effect when the offense was committed, and the | |
| 24 | 24 | former law is continued in effect for that purpose. For purposes of | |
| 25 | 25 | this section, an offense was committed before the effective date of | |
| 26 | 26 | this Act if any element of the offense occurred before that date. | |
| 27 | 27 | SECTION 3. This Act takes effect September 1, 2009. |
