| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Chapter 493, Government Code, is amended by | |
| 12 | 12 | adding Section 493.029 to read as follows: | |
| 13 | 13 | Sec. 493.029. TOBACCO PRODUCTS. (a) In this section: | |
| 14 | 14 | (1) "Cigarette" has the meaning assigned by Section | |
| 15 | 15 | 154.001, Tax Code. | |
| 16 | 16 | (2) "Tobacco product" has the meaning assigned by | |
| 17 | 17 | Section 155.001, Tax Code. | |
| 18 | 18 | (b) The board shall adopt a rule that permits the possession | |
| 19 | 19 | and use of tobacco products and cigarettes by: | |
| 20 | 20 | (1) employees of and persons in the custody of the | |
| 21 | 21 | department; and | |
| 22 | 22 | (2) visitors to property owned, used, or controlled by | |
| 23 | 23 | the department. | |
| 24 | 24 | (c) The rule must provide for the designation by the | |
| 25 | 25 | executive director of approved areas in which persons in the | |
| 26 | 26 | custody of the department are permitted to use tobacco products and | |
| 27 | 27 | cigarettes. | |
| 28 | 28 | SECTION 2. The Texas Board of Criminal Justice shall adopt | |
| 29 | 29 | the rule described by Section 493.029, Government Code, as added by | |
| 30 | 30 | this Act, not later than October 1, 2009. | |
| 31 | 31 | SECTION 3. This Act takes effect September 1, 2009. |
