| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 263.153, Local Government Code, is |
|---|
| 9 | 9 | | amended by adding Subsection (c) to read as follows: |
|---|
| 10 | 10 | | (c) A county that contracts with an auctioneer licensed |
|---|
| 11 | 11 | | under Chapter 1802, Occupations Code, who uses an Internet auction |
|---|
| 12 | 12 | | site offering online bidding through the Internet to sell surplus |
|---|
| 13 | 13 | | or salvage property under this subchapter having an estimated value |
|---|
| 14 | 14 | | of not more than $500 shall satisfy the notice requirement under |
|---|
| 15 | 15 | | this section by posting the property on the site for at least 10 |
|---|
| 16 | 16 | | days unless the property is sold before the 10th day. |
|---|
| 17 | 17 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 18 | 18 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 19 | 19 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 20 | 20 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 21 | 21 | | Act takes effect September 1, 2009. |
