8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter Z, Chapter 157, Local Government | |
10 | 10 | Code, is amended by adding Section 157.9031 to read as follows: | |
11 | 11 | Sec. 157.9031. AUTHORITY TO REQUIRE REIMBURSEMENT FOR | |
12 | 12 | CERTAIN COVERAGE. An intergovernmental pool operating under | |
13 | 13 | Chapter 119 of this code or under authority granted by Chapter 791 | |
14 | 14 | or 2259, Government Code, or a county commissioners court obtaining | |
15 | 15 | coverage from such a pool may, pursuant to policies concerning the | |
16 | 16 | provision of coverages adopted by the commissioners court or the | |
17 | 17 | pool's governing body, require reimbursement for the provision of | |
18 | 18 | punitive damage coverage from a person to whom the | |
19 | 19 | intergovernmental pool provides coverage. | |
20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
24 | 24 | Act takes effect September 1, 2009. |
