66 AN ACT
77 relating to the accommodation of bicycles, pedestrians, and mass
88 transit riders on streets and highways.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 201, Transportation Code,
1111 is amended by adding Section 201.624 to read as follows:
1212 Sec. 201.624. ACCOMMODATION OF BICYCLISTS, PEDESTRIANS,
1313 AND MASS TRANSIT RIDERS. (a) In this section, "local authority"
1414 means a county, municipality, or other local entity authorized to
1515 plan, construct, and maintain streets and highways.
1616 (b) The commission shall adopt provisions relating to the
1717 accommodation of bicycles, pedestrians, and mass transit riders in
1818 transportation planning.
1919 (c) To implement this section, the department shall
2020 establish minimum guidelines to accommodate bicycles, pedestrians,
2121 and mass transit riders in all transportation planning,
2222 construction, reconstruction, street or highway improvements, and
2323 transportation facilities, including mass transit facilities. The
2424 guidelines must conform to the provisions for bicycle, pedestrian,
2525 and mass transit rider accommodation adopted under Subsection (b).
2626 (d) To implement this section or a local ordinance, a local
2727 authority shall establish minimum guidelines to accommodate
2828 bicycles, pedestrians, and mass transit riders in all
2929 transportation planning, construction, reconstruction, street or
3030 highway improvements, and transportation facilities, including
3131 mass transit facilities. The guidelines must conform to the
3232 provisions for bicycle, pedestrian, and mass transit rider
3333 accommodation adopted under Subsection (b).
3434 (e) A metropolitan planning organization shall establish
3535 minimum guidelines to accommodate bicycles, pedestrians, and mass
3636 transit riders in any transportation improvement plan. The
3737 guidelines must conform to the provisions for bicycle, pedestrian,
3838 and mass transit rider accommodation adopted under Subsection (b).
3939 SECTION 2. This Act takes effect September 1, 2009.
