| 7 | 7 | | relating to the accommodation of bicycles, pedestrians, and mass |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 201, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 201.624 to read as follows: |
|---|
| 12 | 12 | | Sec. 201.624. ACCOMMODATION OF BICYCLISTS, PEDESTRIANS, |
|---|
| 13 | 13 | | AND MASS TRANSIT RIDERS. (a) In this section, "local authority" |
|---|
| 14 | 14 | | means a county, municipality, or other local entity authorized to |
|---|
| 15 | 15 | | plan, construct, and maintain streets and highways. |
|---|
| 16 | 16 | | (b) The commission shall adopt provisions relating to the |
|---|
| 17 | 17 | | accommodation of bicycles, pedestrians, and mass transit riders in |
|---|
| 18 | 18 | | transportation planning. |
|---|
| 19 | 19 | | (c) To implement this section, the department shall |
|---|
| 20 | 20 | | establish minimum guidelines to accommodate bicycles, pedestrians, |
|---|
| 21 | 21 | | and mass transit riders in all transportation planning, |
|---|
| 22 | 22 | | construction, reconstruction, street or highway improvements, and |
|---|
| 23 | 23 | | transportation facilities, including mass transit facilities. The |
|---|
| 24 | 24 | | guidelines must conform to the provisions for bicycle, pedestrian, |
|---|
| 25 | 25 | | and mass transit rider accommodation adopted under Subsection (b). |

| 26 | 26 | | (d) To implement this section or a local ordinance, a local |
|---|
| 27 | 27 | | authority shall establish minimum guidelines to accommodate |
|---|
| 28 | 28 | | bicycles, pedestrians, and mass transit riders in all |
|---|
| 29 | 29 | | transportation planning, construction, reconstruction, street or |
|---|
| 30 | 30 | | highway improvements, and transportation facilities, including |
|---|
| 31 | 31 | | mass transit facilities. The guidelines must conform to the |
|---|
| 32 | 32 | | provisions for bicycle, pedestrian, and mass transit rider |
|---|
| 33 | 33 | | accommodation adopted under Subsection (b). |
|---|
| 34 | 34 | | (e) A metropolitan planning organization shall establish |
|---|
| 35 | 35 | | minimum guidelines to accommodate bicycles, pedestrians, and mass |
|---|
| 36 | 36 | | transit riders in any transportation improvement plan. The |
|---|
| 37 | 37 | | guidelines must conform to the provisions for bicycle, pedestrian, |
|---|
| 38 | 38 | | and mass transit rider accommodation adopted under Subsection (b). |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect September 1, 2009. |
