55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the disclosure by a member of the legislature or the
88 lieutenant governor of certain information concerning a resident of
99 this state to a governmental body.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 306.003, Government Code, is amended by
1212 adding Subsection (c) to read as follows:
1313 (c) In this subsection, "governmental body" has the meaning
1414 assigned by Section 552.003. If a member of the legislature or the
1515 lieutenant governor discloses to a governmental body a record to
1616 which Subsection (a) applies or communicates to a governmental body
1717 a description of the information contained in the record that
1818 identifies or would tend to identify the resident of this state who
1919 communicated with the member or lieutenant governor, the record or
2020 the described information, as applicable, in the possession of the
2121 governmental body is subject to and confidential under Subsection
2222 (a) and may be disclosed only to the extent the member of the
2323 legislature or lieutenant governor elects to disclose the record or
2424 the described information.
2525 SECTION 2. Section 306.004, Government Code, is amended by
2626 adding Subsection (d) to read as follows:
2727 (d) In this subsection, "governmental body" has the meaning
2828 assigned by Section 552.003. If a member of the legislature or the
2929 lieutenant governor discloses to a governmental body a
3030 communication to which this section applies or communicates to a
3131 governmental body a description of the information contained in the
3232 communication that identifies or would tend to identify the citizen
3333 of this state who communicated with the member or lieutenant
3434 governor, the communication or the described information, as
3535 applicable, in the possession of the governmental body is subject
3636 to and confidential under this section and may be disclosed only to
3737 the extent the member of the legislature or lieutenant governor
3838 elects to disclose the communication or the described information.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2009.
