| 7 | 7 | | relating to the disclosure by a member of the legislature or the |
|---|
| 8 | 8 | | lieutenant governor of certain information concerning a resident of |
|---|
| 9 | 9 | | this state to a governmental body. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 306.003, Government Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (c) to read as follows: |
|---|
| 13 | 13 | | (c) In this subsection, "governmental body" has the meaning |
|---|
| 14 | 14 | | assigned by Section 552.003. If a member of the legislature or the |
|---|
| 15 | 15 | | lieutenant governor discloses to a governmental body a record to |
|---|
| 16 | 16 | | which Subsection (a) applies or communicates to a governmental body |
|---|
| 17 | 17 | | a description of the information contained in the record that |
|---|
| 18 | 18 | | identifies or would tend to identify the resident of this state who |
|---|
| 19 | 19 | | communicated with the member or lieutenant governor, the record or |
|---|
| 20 | 20 | | the described information, as applicable, in the possession of the |
|---|
| 21 | 21 | | governmental body is subject to and confidential under Subsection |
|---|
| 22 | 22 | | (a) and may be disclosed only to the extent the member of the |
|---|
| 23 | 23 | | legislature or lieutenant governor elects to disclose the record or |
|---|
| 24 | 24 | | the described information. |

| 25 | 25 | | SECTION 2. Section 306.004, Government Code, is amended by |
|---|
| 26 | 26 | | adding Subsection (d) to read as follows: |
|---|
| 27 | 27 | | (d) In this subsection, "governmental body" has the meaning |
|---|
| 28 | 28 | | assigned by Section 552.003. If a member of the legislature or the |
|---|
| 29 | 29 | | lieutenant governor discloses to a governmental body a |
|---|
| 30 | 30 | | communication to which this section applies or communicates to a |
|---|
| 31 | 31 | | governmental body a description of the information contained in the |
|---|
| 32 | 32 | | communication that identifies or would tend to identify the citizen |
|---|
| 33 | 33 | | of this state who communicated with the member or lieutenant |
|---|
| 34 | 34 | | governor, the communication or the described information, as |
|---|
| 35 | 35 | | applicable, in the possession of the governmental body is subject |
|---|
| 36 | 36 | | to and confidential under this section and may be disclosed only to |
|---|
| 37 | 37 | | the extent the member of the legislature or lieutenant governor |
|---|
| 38 | 38 | | elects to disclose the communication or the described information. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2009. |
