| 9 | 9 | | relating to the participation in state travel service contracts by |

| 10 | 10 | | certain local governmental entities. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 2171.055, Government Code, is amended by |
|---|
| 13 | 13 | | adding Subsections (i) and (j) to read as follows: |
|---|
| 14 | 14 | | (i) An officer or employee of a transportation or transit |
|---|
| 15 | 15 | | authority, department, district, or system established under |
|---|
| 16 | 16 | | Subtitle K, Title 6, Transportation Code, who is engaged in |
|---|
| 17 | 17 | | official business of the authority, department, district, or system |
|---|
| 18 | 18 | | may participate in the comptroller's contracts for travel services. |
|---|
| 19 | 19 | | The comptroller may charge a participating authority, department, |
|---|
| 20 | 20 | | district, or system a fee not to exceed the costs incurred by the |
|---|
| 21 | 21 | | comptroller in providing services under this subsection. The |
|---|
| 22 | 22 | | comptroller shall periodically review fees and shall adjust them as |
|---|
| 23 | 23 | | needed to ensure recovery of costs incurred in providing services |
|---|
| 24 | 24 | | to authorities, departments, districts, and systems under this |
|---|
| 25 | 25 | | subsection. |
|---|
| 26 | 26 | | (j) An officer or employee of a hospital district created |
|---|
| 27 | 27 | | under general or special law who is engaged in official hospital |
|---|
| 28 | 28 | | district business may participate in the comptroller's contract for |
|---|
| 29 | 29 | | travel services for the purpose of obtaining reduced airline fares |
|---|
| 30 | 30 | | and reduced travel agent fees. The comptroller may charge a |
|---|
| 31 | 31 | | participating hospital district a fee not to exceed the costs |
|---|
| 32 | 32 | | incurred by the comptroller in providing services under this |
|---|
| 33 | 33 | | subsection. The comptroller shall periodically review fees and |
|---|
| 34 | 34 | | shall adjust them as needed to ensure recovery of costs incurred in |
|---|
| 35 | 35 | | providing services to hospital districts under this subsection. |
|---|
| 36 | 36 | | The comptroller shall deposit the fees collected under this |
|---|
| 37 | 37 | | subsection to the credit of the hospital district airline fares |
|---|
| 38 | 38 | | account. The hospital district airline fares account is an account |
|---|
| 39 | 39 | | in the general revenue fund that may be appropriated only for the |
|---|
| 40 | 40 | | purposes of this chapter. The comptroller shall adopt rules and |
|---|
| 41 | 41 | | make or amend contracts as necessary to administer this subsection. |
|---|
| 42 | 42 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2009. |
