| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter D, Chapter 161, Human Resources Code, |
|---|
| 10 | 10 | | is amended by adding Section 161.078 to read as follows: |
|---|
| 11 | 11 | | Sec. 161.078. REQUIREMENTS REGARDING PRESENTATION OF |
|---|
| 12 | 12 | | COMMUNITY LIVING OPTIONS. The department shall ensure that a |
|---|
| 13 | 13 | | brochure, pamphlet, or other material used during the community |
|---|
| 14 | 14 | | living options information process under Section 531.02442 or |
|---|
| 15 | 15 | | 531.02443, Government Code, presents information regarding each |
|---|
| 16 | 16 | | living option in a neutral manner. |
|---|
| 17 | 17 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 18 | 18 | | a state agency determines that a waiver or authorization from a |
|---|
| 19 | 19 | | federal agency is necessary for implementation of that provision, |
|---|
| 20 | 20 | | the agency affected by the provision shall request the waiver or |
|---|
| 21 | 21 | | authorization and may delay implementing that provision until the |
|---|
| 22 | 22 | | waiver or authorization is granted. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2009. |
