| 7 | 7 | | relating to a registration fee for manufacturers of certain |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 361.962, Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 361.962. FEES [NOT AUTHORIZED]. (a) The commission |
|---|
| 13 | 13 | | shall impose an annual registration fee of $5,000 on each |
|---|
| 14 | 14 | | manufacturer whose volume of sales of any type of equipment to which |
|---|
| 15 | 15 | | this subchapter applies in a calendar year exceeds one percent of |
|---|
| 16 | 16 | | the market share in this state. A manufacturer shall pay the |
|---|
| 17 | 17 | | registration fee on or before March 31. |
|---|
| 18 | 18 | | (b) Except as provided by Subsection (a), this [This] |
|---|
| 19 | 19 | | subchapter does not authorize the commission to impose a fee, |
|---|
| 20 | 20 | | including a recycling fee or registration fee, on a consumer, |
|---|
| 21 | 21 | | manufacturer, retailer, or person who recycles or reuses computer |
|---|
| 22 | 22 | | equipment. |
|---|
| 23 | 23 | | SECTION 2. (a) The Texas Commission on Environmental |
|---|
| 24 | 24 | | Quality shall adopt any rules required to implement the changes in |
|---|
| 25 | 25 | | law made by Section 361.962, Health and Safety Code, as amended by |
|---|
| 26 | 26 | | this Act, not later than May 1, 2010. |
|---|
| 27 | 27 | | (b) The registration fee required by Section 361.962, |
|---|
| 28 | 28 | | Health and Safety Code, as amended by this Act, is not due for the |
|---|
| 29 | 29 | | first time before March 31, 2011. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2009. |
|---|
