| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 1, Education Code, is amended by adding |
|---|
| 11 | 11 | | Section 1.0021 to read as follows: |
|---|
| 12 | 12 | | Sec. 1.0021. DISCRIMINATION PROHIBITED. (a) In this |
|---|
| 13 | 13 | | section: |
|---|
| 14 | 14 | | (1) "Gender identity or expression" means having or |
|---|
| 15 | 15 | | being perceived as having a gender-related identity, appearance, |
|---|
| 16 | 16 | | expression, or behavior, whether or not that identity, appearance, |
|---|
| 17 | 17 | | expression, or behavior is different from that commonly associated |
|---|
| 18 | 18 | | with the person's actual or perceived sex. |
|---|
| 19 | 19 | | (2) "Sexual orientation" means the actual or perceived |
|---|
| 20 | 20 | | status of an individual with respect to the individual's sexuality. |
|---|
| 21 | 21 | | (b) A public educational institution or employee of a public |
|---|
| 22 | 22 | | educational institution may not discriminate against a student |
|---|
| 23 | 23 | | enrolled in the institution on account of the ethnicity, color, |
|---|
| 24 | 24 | | gender, gender identity or expression, sexual orientation, |
|---|
| 25 | 25 | | disability, religion, or national origin of the student or the |
|---|
| 26 | 26 | | student's parent. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
