66 AN ACT
77 relating to a prohibition of discrimination by public educational
88 institutions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1, Education Code, is amended by adding
1111 Section 1.0021 to read as follows:
1212 Sec. 1.0021. DISCRIMINATION PROHIBITED. (a) In this
1313 section:
1414 (1) "Gender identity or expression" means having or
1515 being perceived as having a gender-related identity, appearance,
1616 expression, or behavior, whether or not that identity, appearance,
1717 expression, or behavior is different from that commonly associated
1818 with the person's actual or perceived sex.
1919 (2) "Sexual orientation" means the actual or perceived
2020 status of an individual with respect to the individual's sexuality.
2121 (b) A public educational institution or employee of a public
2222 educational institution may not discriminate against a student
2323 enrolled in the institution on account of the ethnicity, color,
2424 gender, gender identity or expression, sexual orientation,
2525 disability, religion, or national origin of the student or the
2626 student's parent.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
