6	6	AN ACT
7	7	relating to the establishment and funding of emergency medical
8	8	power stations.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 418.042(a), Government Code, is amended
11	11	to read as follows:
12	12	(a) The division shall prepare and keep current a
13	13	comprehensive state emergency management plan. The plan may
14	14	include:
15	15	(1) provisions for prevention and minimization of
16	16	injury and damage caused by disaster;
17	17	(2) provisions for prompt and effective response to
18	18	disaster;
19	19	(3) provisions for emergency relief;
20	20	(4) provisions for energy emergencies;
21	21	(5) identification of areas particularly vulnerable
22	22	to disasters;
23	23	(6) recommendations for zoning, building
24	24	restrictions, and other land-use controls, safety measures for
25	25	securing mobile homes or other nonpermanent or semipermanent
26	26	structures, and other preventive and preparedness measures
27	27	designed to eliminate or reduce disasters or their impact;
28	28	(7) provisions for assistance to local officials in
29	29	designing local emergency management plans;
30	30	(8) authorization and procedures for the erection or
31	31	other construction of temporary works designed to protect against
32	32	or mitigate danger, damage, or loss from flood, fire, or other
33	33	disaster;
34	34	(9) preparation and distribution to the appropriate
35	35	state and local officials of state catalogs of federal, state, and
36	36	private assistance programs;
37	37	(10) organization of manpower and channels of
38	38	assistance;
39	39	(11) coordination of federal, state, and local
40	40	emergency management activities;
41	41	(12) coordination of the state emergency management
42	42	plan with the emergency management plans of the federal government;
43	43	(13) coordination of federal and state energy
44	44	emergency plans;
45	45	(14) provisions for education and training of local
46	46	officials on activation of the Emergency Alert System established
47	47	under 47 C.F.R. Part 11; [and]
48	48	(15) provisions for establishing, in cooperation with
49	49	local hospitals, emergency medical power stations where residents
50	50	affected by a power outage following a disaster can power medical
51	51	devices, including life support equipment, without visiting a
52	52	hospital; and
53	53	(16) other necessary matters relating to disasters.
54	54	SECTION 2. Section 418.073, Government Code, is amended by
55	55	adding Subsection (e) to read as follows:
56	56	(e) A state agency, political subdivision, or hospital may
57	57	request funding from the disaster contingency fund to pay for the
58	58	costs of establishing and operating an emergency medical power
59	59	station where residents affected by a power outage following a
60	60	disaster can power medical devices, including life support
61	61	equipment, without visiting a hospital. To the extent funds are
62	62	available, the division shall approve all reasonable requests for
63	63	funding under this subsection.
64	64	SECTION 3. This Act takes effect immediately if it receives
65	65	a vote of two-thirds of all the members elected to each house, as
66	66	provided by Section 39, Article III, Texas Constitution. If this
67	67	Act does not receive the vote necessary for immediate effect, this
68	68	Act takes effect September 1, 2009.
