66 AN ACT
77 relating to the establishment and funding of emergency medical
88 power stations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 418.042(a), Government Code, is amended
1111 to read as follows:
1212 (a) The division shall prepare and keep current a
1313 comprehensive state emergency management plan. The plan may
1414 include:
1515 (1) provisions for prevention and minimization of
1616 injury and damage caused by disaster;
1717 (2) provisions for prompt and effective response to
1818 disaster;
1919 (3) provisions for emergency relief;
2020 (4) provisions for energy emergencies;
2121 (5) identification of areas particularly vulnerable
2222 to disasters;
2323 (6) recommendations for zoning, building
2424 restrictions, and other land-use controls, safety measures for
2525 securing mobile homes or other nonpermanent or semipermanent
2626 structures, and other preventive and preparedness measures
2727 designed to eliminate or reduce disasters or their impact;
2828 (7) provisions for assistance to local officials in
2929 designing local emergency management plans;
3030 (8) authorization and procedures for the erection or
3131 other construction of temporary works designed to protect against
3232 or mitigate danger, damage, or loss from flood, fire, or other
3333 disaster;
3434 (9) preparation and distribution to the appropriate
3535 state and local officials of state catalogs of federal, state, and
3636 private assistance programs;
3737 (10) organization of manpower and channels of
3838 assistance;
3939 (11) coordination of federal, state, and local
4040 emergency management activities;
4141 (12) coordination of the state emergency management
4242 plan with the emergency management plans of the federal government;
4343 (13) coordination of federal and state energy
4444 emergency plans;
4545 (14) provisions for education and training of local
4646 officials on activation of the Emergency Alert System established
4747 under 47 C.F.R. Part 11; [and]
4848 (15) provisions for establishing, in cooperation with
4949 local hospitals, emergency medical power stations where residents
5050 affected by a power outage following a disaster can power medical
5151 devices, including life support equipment, without visiting a
5252 hospital; and
5353 (16) other necessary matters relating to disasters.
5454 SECTION 2. Section 418.073, Government Code, is amended by
5555 adding Subsection (e) to read as follows:
5656 (e) A state agency, political subdivision, or hospital may
5757 request funding from the disaster contingency fund to pay for the
5858 costs of establishing and operating an emergency medical power
5959 station where residents affected by a power outage following a
6060 disaster can power medical devices, including life support
6161 equipment, without visiting a hospital. To the extent funds are
6262 available, the division shall approve all reasonable requests for
6363 funding under this subsection.
6464 SECTION 3. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2009.
