| 7 | 7 | | relating to the requirement that certain orders closing, |

| 8 | 8 | | abandoning, or vacating a county road be filed and indexed in the |

| 9 | 9 | | deed records of the county where the road is located. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 251.058(b), Transportation Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (b) Title to a public road or portion of a public road that |
|---|
| 14 | 14 | | is closed, abandoned, and vacated to the center line of the road |
|---|
| 15 | 15 | | vests on the date the order is signed by the county judge in the |
|---|
| 16 | 16 | | owner of the property that abuts the portion of the road being |
|---|
| 17 | 17 | | closed, abandoned, and vacated. A copy of the order shall be filed |
|---|
| 18 | 18 | | in the deed records of the county and serves as the official |
|---|
| 19 | 19 | | instrument of conveyance from the county to the owner of the |
|---|
| 20 | 20 | | abutting property. The order shall: |
|---|
| 21 | 21 | | (1) include the name of each property owner who |
|---|
| 22 | 22 | | receives a conveyance under this section; |
|---|
| 23 | 23 | | (2) include the dimensions of the property being |
|---|
| 24 | 24 | | conveyed to each property owner; and |
|---|
| 25 | 25 | | (3) be indexed in the deed records of the county in a |
|---|
| 26 | 26 | | manner that describes: |
|---|
| 27 | 27 | | (A) the county conveying the property as grantor; |
|---|
| 28 | 28 | | and |
|---|
| 29 | 29 | | (B) the property owner receiving the conveyance |
|---|
| 30 | 30 | | as grantee. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2009. |
