| 9 | 9 | | employees against elementary, middle, and junior high school |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 37, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 37.0811 to read as follows: |
|---|
| 14 | 14 | | Sec. 37.0811. USE OF STUN GUN OR TASER AGAINST CERTAIN |
|---|
| 15 | 15 | | STUDENTS PROHIBITED. (a) In this section: |
|---|
| 16 | 16 | | (1) "Stun gun" has the meaning assigned by Section |
|---|
| 17 | 17 | | 38.14, Penal Code. |
|---|
| 18 | 18 | | (2) "Taser" means a device that is intended, designed, |
|---|
| 19 | 19 | | made, or adapted to incapacitate a person by inflicting an |
|---|
| 20 | 20 | | electrical charge through the emission of a projectile or |
|---|
| 21 | 21 | | conductive stream. |
|---|
| 22 | 22 | | (b) The board of trustees of a school district shall |
|---|
| 23 | 23 | | prohibit school district peace officers, security personnel, and |
|---|
| 24 | 24 | | other employees from using a stun gun or taser to subdue an |
|---|
| 25 | 25 | | elementary, middle, or junior high school student on school |
|---|
| 26 | 26 | | property or while attending a school-sponsored or school-related |
|---|
| 27 | 27 | | activity off of school property. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2009. |
