66 AN ACT
77 relating to a prohibition against the use of a stun gun or taser by
88 school district peace officers, security personnel, and other
99 employees against elementary, middle, and junior high school
1010 students.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 37, Education Code, is
1313 amended by adding Section 37.0811 to read as follows:
1414 Sec. 37.0811. USE OF STUN GUN OR TASER AGAINST CERTAIN
1515 STUDENTS PROHIBITED. (a) In this section:
1616 (1) "Stun gun" has the meaning assigned by Section
1717 38.14, Penal Code.
1818 (2) "Taser" means a device that is intended, designed,
1919 made, or adapted to incapacitate a person by inflicting an
2020 electrical charge through the emission of a projectile or
2121 conductive stream.
2222 (b) The board of trustees of a school district shall
2323 prohibit school district peace officers, security personnel, and
2424 other employees from using a stun gun or taser to subdue an
2525 elementary, middle, or junior high school student on school
2626 property or while attending a school-sponsored or school-related
2727 activity off of school property.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2009.
