66 AN ACT
77 relating to the regulation of solar energy panels by a property
88 owners' association.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 202, Property Code, is amended by adding
1111 Section 202.010 to read as follows:
1212 Sec. 202.010. REGULATION OF SOLAR ENERGY PANELS. (a) In
1313 this section, "solar energy panel" means a panel device or system
1414 designed primarily to:
1515 (1) collect solar energy, as defined by Section
1616 2166.403, Government Code; or
1717 (2) collect and subsequently use solar energy as
1818 thermal, mechanical, or electrical energy.
1919 (b) Except as otherwise provided by this section, a property
2020 owners' association may not include or enforce a provision in a
2121 dedicatory instrument that prohibits or restricts a property owner
2222 from installing a solar energy panel.
2323 (c) A provision that violates Subsection (b) is void.
2424 (d) This section does not prohibit the inclusion or
2525 enforcement of a provision in a dedicatory instrument that
2626 prohibits a solar energy panel that:
2727 (1) threatens the public health or safety;
2828 (2) violates a law;
2929 (3) is located on property owned or maintained by the
3030 property owners' association;
3131 (4) is located on property owned in common by the
3232 members of the property owners' association;
3333 (5) is located in an area on the property owner's
3434 property other than:
3535 (A) on the roof of the home; or
3636 (B) in a fenced yard or patio maintained by the
3737 property owner; or
3838 (6) is mounted on a device that is taller or more
3939 visually obtrusive than is necessary for the panel to operate at not
4040 less than 90 percent of its rated efficiency.
4141 SECTION 2. Section 202.010, Property Code, as added by this
4242 Act, applies to a provision in a dedicatory instrument without
4343 regard to whether the provision or the dedicatory instrument takes
4444 effect or is renewed before, on, or after the effective date of this
4545 Act.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2009.
