| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 521.142(e), Transportation Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (e) The application must include any other information the | |
| 13 | 13 | department requires to determine the applicant's identity, | |
| 14 | 14 | competency, and eligibility, except the application may not include | |
| 15 | 15 | an inquiry as to whether the applicant has been diagnosed with, | |
| 16 | 16 | treated, or hospitalized for a psychiatric disorder. | |
| 17 | 17 | SECTION 2. The change in law made by this Act applies only | |
| 18 | 18 | to an application for a driver's license filed on or after the | |
| 19 | 19 | effective date of this Act. An application filed before the | |
| 20 | 20 | effective date of this Act is subject to the law in effect on the | |
| 21 | 21 | date of filing, and that law is continued in effect for that | |
| 22 | 22 | purpose. | |
| 23 | 23 | SECTION 3. This Act takes effect September 1, 2009. |
