66 AN ACT
77 relating to health benefit plan coverage for certain serious mental
88 illnesses and mental disorders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1355.001, Insurance Code, is amended by
1111 amending Subdivision (1) and adding Subdivision (5) to read as
1212 follows:
1313 (1) "Serious mental illness" means [the following]
1414 psychiatric illnesses as defined by the American Psychiatric
1515 Association in the Diagnostic and Statistical Manual (DSM), fourth
1616 edition, or a later edition of that manual that the commissioner
1717 adopts by rule. The term includes:
1818 (A) bipolar disorders (hypomanic, manic,
1919 depressive, and mixed);
2020 (B) depression in childhood and adolescence;
2121 (C) major depressive disorders (single episode
2222 or recurrent);
2323 (D) obsessive-compulsive disorders;
2424 (E) paranoid and other psychotic disorders;
2525 (F) schizo-affective disorders (bipolar or
2626 depressive); and
2727 (G) schizophrenia.
2828 (5) "Mental disorder" means a disorder defined by the
2929 American Psychiatric Association in the Diagnostic and Statistical
3030 Manual (DSM), fourth edition, or a later edition of that manual that
3131 the commissioner adopts by rule. The term does not include:
3232 (A) a condition classified by the manual as a
3333 "V-code" disorder;
3434 (B) mental retardation;
3535 (C) a learning disorder;
3636 (D) a motor skill disorder; or
3737 (E) a communication disorder.
3838 SECTION 2. Subchapter F, Chapter 1501, Insurance Code, is
3939 amended by adding Section 1501.253 to read as follows:
4040 Sec. 1501.253. MENTAL HEALTH BENEFITS. (a) In this
4141 section:
4242 (1) "Mental disorder" has the meaning assigned by
4343 Section 1355.001.
4444 (2) "Serious mental illness" has the meaning assigned
4545 by Section 1355.001.
4646 (b) Notwithstanding Chapter 1507, a small employer health
4747 benefit plan issuer shall offer coverage under the standard health
4848 benefit plan offered under Section 1501.252, based on medical
4949 necessity, for treatment of a serious mental illness or a mental
5050 disorder that is not classified as a serious mental illness that is
5151 equal to the coverage the plan includes for physical illness. The
5252 issuer is not required to provide the coverage required under this
5353 subsection if the employer rejects the coverage.
5454 SECTION 3. Subchapter M, Chapter 1501, Insurance Code, is
5555 amended by adding Section 1501.6025 to read as follows:
5656 Sec. 1501.6025. MENTAL HEALTH BENEFITS. (a) In this
5757 section:
5858 (1) "Mental disorder" has the meaning assigned by
5959 Section 1355.001.
6060 (2) "Serious mental illness" has the meaning assigned
6161 by Section 1355.001.
6262 (b) A large employer health benefit plan issuer shall offer
6363 coverage, based on medical necessity, for treatment of a mental
6464 disorder that is not classified as a serious mental illness that is
6565 equal to the coverage the plan includes for physical illness. The
6666 issuer is not required to provide the coverage required under this
6767 subsection if the employer rejects the coverage.
6868 SECTION 4. The change in law made by this Act applies only
6969 to a small employer health benefit plan or large employer health
7070 benefit plan that is delivered, issued for delivery, or renewed on
7171 or after January 1, 2010. A health benefit plan that is delivered,
7272 issued for delivery, or renewed before January 1, 2010, is covered
7373 by the law in effect at the time the plan was delivered, issued for
7474 delivery, or renewed, and that law is continued in effect for that
7575 purpose.
7676 SECTION 5. This Act takes effect September 1, 2009.
