| 10 | 10 | SECTION 1. Section 157.262(f), Family Code, is amended to | |

| 12 | 12 | (f) A lump sum dependent's disability payment made by the | |
| 13 | 13 | Social Security Administration or the Veterans Administration to | |
| 14 | 14 | the obligee for the benefit of the child as a result of the | |
| 15 | 15 | obligor's disability may be used by the obligor as a counterclaim or | |
| 16 | 16 | offset to a [The] money judgment for arrearages [rendered by the | |

| 19 | 19 | SECTION 2. The change in law made by this Act applies to a | |
| 20 | 20 | motion for enforcement of child support that is pending in a trial | |
| 21 | 21 | court on or filed on or after the effective date of this Act. | |
| 22 | 22 | SECTION 3. This Act takes effect September 1, 2009. |
