66 AN ACT
77 relating to the distribution of proceeds from the sale of forfeited
88 property in a criminal case.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 59.06, Code of Criminal Procedure, is
1111 amended by adding Subsection (c-1) to read as follows:
1212 (c-1) Notwithstanding Subsection (a), the attorney
1313 representing the state and special rangers of the Texas and
1414 Southwestern Cattle Raisers Association who meet the requirements
1515 of Article 2.125 may enter into a local agreement that allows the
1616 attorney representing the state to transfer proceeds from the sale
1717 of forfeited property described by Subsection (c), after the
1818 deduction of court costs as described by that subsection, to a
1919 special fund established for the special rangers. Proceeds
2020 transferred under this subsection must be used by the special
2121 rangers solely for law enforcement purposes, such as training,
2222 essential equipment, and operating expenses. Any expenditures of
2323 the proceeds are subject to the audit provisions established under
2424 this article.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2009.
