| 5 | 5 | | relating to the creation of a bail bond board by the commissioners |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 1704.052, Occupations Code, is amended |
|---|
| 9 | 9 | | to read as follows: |
|---|
| 10 | 10 | | Sec. 1704.052. DISCRETIONARY CREATION OF BOARD. A board |
|---|
| 11 | 11 | | may be created in a county with a population of less than 110,000 |
|---|
| 12 | 12 | | if: |
|---|
| 13 | 13 | | (1) a majority of the persons who would serve as |
|---|
| 14 | 14 | | members of the board under Section 1704.053, or who would designate |
|---|
| 15 | 15 | | the persons who would serve as members of the board, determine to |
|---|
| 16 | 16 | | create a board; and |
|---|
| 17 | 17 | | (2) the commissioners court approves the creation of |
|---|
| 18 | 18 | | the board by a majority vote. |
|---|
| 19 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2009. |
