55 relating to the creation of a bail bond board by the commissioners

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 1704.052, Occupations Code, is amended
99 to read as follows:
1010 Sec. 1704.052. DISCRETIONARY CREATION OF BOARD. A board
1111 may be created in a county with a population of less than 110,000
1212 if:
1313 (1) a majority of the persons who would serve as
1414 members of the board under Section 1704.053, or who would designate
1515 the persons who would serve as members of the board, determine to
1616 create a board; and
1717 (2) the commissioners court approves the creation of
1818 the board by a majority vote.
1919 SECTION 2. This Act takes effect immediately if it receives
2020 a vote of two-thirds of all the members elected to each house, as
2121 provided by Section 39, Article III, Texas Constitution. If this
2222 Act does not receive the vote necessary for immediate effect, this
2323 Act takes effect September 1, 2009.
