| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 2171.004, Insurance Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 2171.004. [RATE] FILINGS. An insurer shall file with |
|---|
| 12 | 12 | | the commissioner in accordance with Chapter 2251 the following |
|---|
| 13 | 13 | | information for commercial group property insurance written under |
|---|
| 14 | 14 | | this chapter in this state: |
|---|
| 15 | 15 | | (1) rates; |
|---|
| 16 | 16 | | (2) deductibles; |
|---|
| 17 | 17 | | (3) supplementary rating information; and |
|---|
| 18 | 18 | | (4) [(3)] pertinent supporting information. |
|---|
| 19 | 19 | | SECTION 2. Subchapter D, Chapter 2211, Insurance Code, is |
|---|
| 20 | 20 | | amended by adding Section 2211.158 to read as follows: |
|---|
| 21 | 21 | | Sec. 2211.158. RULES REGARDING COVERAGE. The commissioner |
|---|
| 22 | 22 | | shall adopt rules as necessary to implement this subchapter, |
|---|
| 23 | 23 | | including any rules necessary to: |
|---|
| 24 | 24 | | (1) implement changes in the plan of operation; and |
|---|
| 25 | 25 | | (2) standardize deductibles charged by the |
|---|
| 26 | 26 | | association. |
|---|
| 27 | 27 | | SECTION 3. Subchapter B, Chapter 2251, Insurance Code, is |
|---|
| 28 | 28 | | amended by adding Section 2251.053 to read as follows: |
|---|
| 29 | 29 | | Sec. 2251.053. DEDUCTIBLES. The commissioner by rule may |
|---|
| 30 | 30 | | establish standards by which an insurer shall set deductible |
|---|
| 31 | 31 | | amounts for residential and commercial insurance. |
|---|
| 32 | 32 | | SECTION 4. This Act applies only to an insurance policy or |
|---|
| 33 | 33 | | contract or evidence of coverage that is delivered, issued for |
|---|
| 34 | 34 | | delivery, or renewed on or after January 1, 2010. An insurance |
|---|
| 35 | 35 | | policy or contract or evidence of coverage delivered, issued for |
|---|
| 36 | 36 | | delivery, or renewed before January 1, 2010, is governed by the law |
|---|
| 37 | 37 | | as it existed immediately before the effective date of this Act, and |
|---|
| 38 | 38 | | that law is continued in effect for that purpose. |

| 39 | 39 | | SECTION 5. This Act takes effect September 1, 2009. |
