| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Chapter 420, Property Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | CHAPTER 420. REGULATION OF BUILDING CONTRACTS AND TRANSFERS OF |
|---|
| 13 | 13 | | TITLE FROM BUILDER [CONTRACT PROVISIONS] |

| 14 | 14 | | SECTION 2. Chapter 420, Property Code, is amended by adding |
|---|
| 15 | 15 | | Section 420.004 to read as follows: |
|---|
| 16 | 16 | | Sec. 420.004. CONSTRUCTION DOCUMENTS. A builder who |
|---|
| 17 | 17 | | constructs a new home must provide a copy of any documents used in |
|---|
| 18 | 18 | | the construction of the home, including written specifications or |
|---|
| 19 | 19 | | blueprints: |
|---|
| 20 | 20 | | (1) at the time the construction is completed, to the |
|---|
| 21 | 21 | | person who contracted with the builder for the construction of the |
|---|
| 22 | 22 | | home; or |
|---|
| 23 | 23 | | (2) at the time title to the home is transferred by the |
|---|
| 24 | 24 | | builder, to the person who purchases the home from the builder. |
|---|
| 25 | 25 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 26 | 26 | | to a contract entered into or a transfer of title made on or after |
|---|
| 27 | 27 | | the effective date of this Act. A contract entered into or a |
|---|
| 28 | 28 | | transfer of title made before the effective date of this Act is |
|---|
| 29 | 29 | | governed by the law in effect immediately before the effective date |
|---|
| 30 | 30 | | of this Act, and that law is continued in effect for that purpose. |
|---|
| 31 | 31 | | SECTION 4. This Act takes effect September 1, 2009. |
