9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 2, Code of Criminal Procedure, is | |
11 | 11 | amended by adding Article 2.31 to read as follows: | |
12 | 12 | Art. 2.31. TEMPORARY MORATORIUM ON STUN GUN USE. (a) In | |
13 | 13 | this article: | |
14 | 14 | (1) "Law enforcement agency" has the meaning assigned | |
15 | 15 | by Article 59.01. | |
16 | 16 | (2) "Stun gun" means a device designed to propel darts | |
17 | 17 | or other projectiles attached to wires that, on contact, will | |
18 | 18 | deliver an electrical pulse capable of incapacitating a person. | |
19 | 19 | (b) A peace officer may not use a stun gun against an | |
20 | 20 | individual. | |
21 | 21 | (c) A law enforcement agency may not purchase a stun gun. | |
22 | 22 | (d) This article expires January 1, 2011. | |
23 | 23 | SECTION 2. This Act takes effect January 1, 2010. |
