| 7 | 7 | | relating to the regulation of air conditioning and refrigeration |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1302.101, Occupations Code, is amended |
|---|
| 11 | 11 | | by adding Subsection (f) to read as follows: |
|---|
| 12 | 12 | | (f) The commission shall adopt rules under this chapter |
|---|
| 13 | 13 | | necessary to comply with Chapter 53. |
|---|
| 14 | 14 | | SECTION 2. Section 1302.260(b), Occupations Code, is |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | (b) A license issued under this chapter is valid for one |
|---|
| 17 | 17 | | year from the date of issuance [expires at the end of the license |
|---|
| 18 | 18 | | period set by the commission]. |
|---|
| 19 | 19 | | SECTION 3. Subchapter F, Chapter 1302, Occupations Code, is |
|---|
| 20 | 20 | | amended by adding Section 1302.2601 to read as follows: |
|---|
| 21 | 21 | | Sec. 1302.2601. RENEWAL OF LICENSE OR REGISTRATION. (a) On |
|---|
| 22 | 22 | | payment of the required fee, a license or registration under this |
|---|
| 23 | 23 | | chapter may be renewed annually. |
|---|
| 24 | 24 | | (b) Notwithstanding Sections 51.401(c) and (d), a person |
|---|
| 25 | 25 | | whose license or registration has been expired for more than 90 days |
|---|
| 26 | 26 | | but less than two years may renew the license or registration by |
|---|
| 27 | 27 | | paying to the department a renewal fee that is equal to two times |
|---|
| 28 | 28 | | the normally required renewal fee. A person whose license or |
|---|
| 29 | 29 | | registration has been expired for two years or more may not renew |
|---|
| 30 | 30 | | the license or registration. The person may obtain a new license by |
|---|
| 31 | 31 | | complying with the requirements and procedures for obtaining an |
|---|
| 32 | 32 | | original license or registration. |
|---|
| 33 | 33 | | SECTION 4. Not later than January 1, 2010, the Texas |
|---|
| 34 | 34 | | Commission of Licensing and Regulation shall adopt rules under |
|---|
| 35 | 35 | | Section 1302.101(f), Occupations Code, as added by this Act. |
|---|
| 36 | 36 | | SECTION 5. (a) The change in law made by this Act by the |
|---|
| 37 | 37 | | amendment of Section 1302.260, Occupations Code, applies only to a |
|---|
| 38 | 38 | | license issued or renewed on or after the effective date of this |
|---|
| 39 | 39 | | Act. A license issued or renewed before the effective date of this |
|---|
| 40 | 40 | | Act is governed by the law in effect on the date the license was |
|---|
| 41 | 41 | | issued or renewed, and the former law is continued in effect for |
|---|
| 42 | 42 | | that purpose. |
|---|
| 43 | 43 | | (b) The change in law made by this Act by the enactment of |
|---|
| 44 | 44 | | Section 1302.2601(b), Occupations Code, applies only to a license |
|---|
| 45 | 45 | | or registration that expires on or after the effective date of this |
|---|
| 46 | 46 | | Act. A license or registration that expires before that date is |
|---|
| 47 | 47 | | governed by the law in effect on the date the license or |
|---|
| 48 | 48 | | registration expired, and the former law is continued in effect for |
|---|
| 49 | 49 | | that purpose. |
|---|
| 50 | 50 | | SECTION 6. This Act takes effect September 1, 2009. |
