66 AN ACT
77 relating to the regulation of air conditioning and refrigeration
88 technicians.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1302.101, Occupations Code, is amended
1111 by adding Subsection (f) to read as follows:
1212 (f) The commission shall adopt rules under this chapter
1313 necessary to comply with Chapter 53.
1414 SECTION 2. Section 1302.260(b), Occupations Code, is
1515 amended to read as follows:
1616 (b) A license issued under this chapter is valid for one
1717 year from the date of issuance [expires at the end of the license
1818 period set by the commission].
1919 SECTION 3. Subchapter F, Chapter 1302, Occupations Code, is
2020 amended by adding Section 1302.2601 to read as follows:
2121 Sec. 1302.2601. RENEWAL OF LICENSE OR REGISTRATION. (a) On
2222 payment of the required fee, a license or registration under this
2323 chapter may be renewed annually.
2424 (b) Notwithstanding Sections 51.401(c) and (d), a person
2525 whose license or registration has been expired for more than 90 days
2626 but less than two years may renew the license or registration by
2727 paying to the department a renewal fee that is equal to two times
2828 the normally required renewal fee. A person whose license or
2929 registration has been expired for two years or more may not renew
3030 the license or registration. The person may obtain a new license by
3131 complying with the requirements and procedures for obtaining an
3232 original license or registration.
3333 SECTION 4. Not later than January 1, 2010, the Texas
3434 Commission of Licensing and Regulation shall adopt rules under
3535 Section 1302.101(f), Occupations Code, as added by this Act.
3636 SECTION 5. (a) The change in law made by this Act by the
3737 amendment of Section 1302.260, Occupations Code, applies only to a
3838 license issued or renewed on or after the effective date of this
3939 Act. A license issued or renewed before the effective date of this
4040 Act is governed by the law in effect on the date the license was
4141 issued or renewed, and the former law is continued in effect for
4242 that purpose.
4343 (b) The change in law made by this Act by the enactment of
4444 Section 1302.2601(b), Occupations Code, applies only to a license
4545 or registration that expires on or after the effective date of this
4646 Act. A license or registration that expires before that date is
4747 governed by the law in effect on the date the license or
4848 registration expired, and the former law is continued in effect for
4949 that purpose.
5050 SECTION 6. This Act takes effect September 1, 2009.
