| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 39.252, Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 39.252. NOTICE ON DISTRICT WEBSITE. Not later than the |
|---|
| 12 | 12 | | 10th day after the first day of instruction of each school year, a |
|---|
| 13 | 13 | | school district that maintains an Internet website shall make the |
|---|
| 14 | 14 | | following information available to the public through a link |
|---|
| 15 | 15 | | displayed prominently on the front page of [on] the website: |
|---|
| 16 | 16 | | (1) the information contained in the most recent |
|---|
| 17 | 17 | | campus report card for each campus in the district, as determined |
|---|
| 18 | 18 | | under Section 39.052; |
|---|
| 19 | 19 | | (2) the information contained in the most recent |
|---|
| 20 | 20 | | performance report for the district, as determined under Section |
|---|
| 21 | 21 | | 39.053, including the information listed under Section 39.053(e); |
|---|
| 22 | 22 | | (3) the most recent performance rating of the |
|---|
| 23 | 23 | | district, as determined under Section 39.072; [and] |
|---|
| 24 | 24 | | (4) a definition and explanation of each performance |
|---|
| 25 | 25 | | rating described by Section 39.072(a); |
|---|
| 26 | 26 | | (5) educator statistics, including how many educators |
|---|
| 27 | 27 | | employed by the district are not certified, and educator attrition |
|---|
| 28 | 28 | | rates; and |
|---|
| 29 | 29 | | (6) student disciplinary information, including: |
|---|
| 30 | 30 | | (A) the number of in-school suspensions; and |
|---|
| 31 | 31 | | (B) the number of out-of-school suspensions. |
|---|
| 32 | 32 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 33 | 33 | | school year. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2009. |
