| 7 | 7 | | relating to the registration of certain vehicles used to provide |
|---|
| 8 | 8 | | emergency incident rehabilitation services. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Subchapter E, Chapter 502, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 502.2036 to read as follows: |
|---|
| 12 | 12 | | Sec. 502.2036. VEHICLES USED FOR EMERGENCY INCIDENT |
|---|
| 13 | 13 | | REHABILITATION. (a) In this section: |
|---|
| 14 | 14 | | (1) "Emergency incident rehabilitation" means the |
|---|
| 15 | 15 | | providing of emergency incident support services for emergency |
|---|
| 16 | 16 | | personnel, including firefighters, law enforcement personnel, and |
|---|
| 17 | 17 | | emergency medical technicians. |
|---|
| 18 | 18 | | (2) "Emergency incident support services" include: |
|---|
| 19 | 19 | | (A) providing food, hydration, and shelter to |
|---|
| 20 | 20 | | emergency personnel; |
|---|
| 21 | 21 | | (B) monitoring emergency personnel; and |
|---|
| 22 | 22 | | (C) performing duties at the request of the |
|---|
| 23 | 23 | | person in charge of an emergency incident. |
|---|
| 24 | 24 | | (b) The owner of a motor vehicle, trailer, or semitrailer |
|---|
| 25 | 25 | | may apply for registration under Section 502.201 and is exempt from |
|---|
| 26 | 26 | | the payment of the registration fee that would otherwise be |
|---|
| 27 | 27 | | required by this chapter if the vehicle is owned and used |
|---|
| 28 | 28 | | exclusively for emergency incident rehabilitation by a nonprofit |
|---|
| 29 | 29 | | organization. |
|---|
| 30 | 30 | | (c) An application for registration under this section must |
|---|
| 31 | 31 | | include: |
|---|
| 32 | 32 | | (1) a statement by the owner of the vehicle that the |
|---|
| 33 | 33 | | vehicle is used exclusively for emergency incident rehabilitation |
|---|
| 34 | 34 | | and has not been used for any other purpose; |
|---|
| 35 | 35 | | (2) a statement signed by an officer of the nonprofit |
|---|
| 36 | 36 | | organization that the vehicle has not been used for any purpose |
|---|
| 37 | 37 | | other than emergency incident rehabilitation and qualifies for |
|---|
| 38 | 38 | | registration under this section; and |
|---|
| 39 | 39 | | (3) a reasonable description of the vehicle and the |
|---|
| 40 | 40 | | equipment included in the vehicle. |
|---|
| 41 | 41 | | (d) An applicant for registration under this section must |
|---|
| 42 | 42 | | pay a fee of $5. |
|---|
| 43 | 43 | | (e) A motor vehicle registered under this section must |
|---|
| 44 | 44 | | display the name of the organization that owns it on each front |
|---|
| 45 | 45 | | door. |
|---|
| 46 | 46 | | (f) A vehicle registered under this section must display at |
|---|
| 47 | 47 | | all times an appropriate license plate showing the vehicle's |
|---|
| 48 | 48 | | status. |
|---|
| 49 | 49 | | (g) A vehicle registered under this section that is used for |
|---|
| 50 | 50 | | any purpose other than emergency incident rehabilitation by a |
|---|
| 51 | 51 | | nonprofit organization that provides emergency incident |
|---|
| 52 | 52 | | rehabilitation may not again be registered under this section by |
|---|
| 53 | 53 | | that organization. |
|---|
| 54 | 54 | | SECTION 2. This Act takes effect September 1, 2009. |
