77 relating to the registration of certain vehicles used to provide
88 emergency incident rehabilitation services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 502, Transportation Code,
1111 is amended by adding Section 502.2036 to read as follows:
1212 Sec. 502.2036. VEHICLES USED FOR EMERGENCY INCIDENT
1313 REHABILITATION. (a) In this section:
1414 (1) "Emergency incident rehabilitation" means the
1515 providing of emergency incident support services for emergency
1616 personnel, including firefighters, law enforcement personnel, and
1717 emergency medical technicians.
1818 (2) "Emergency incident support services" include:
1919 (A) providing food, hydration, and shelter to
2020 emergency personnel;
2121 (B) monitoring emergency personnel; and
2222 (C) performing duties at the request of the
2323 person in charge of an emergency incident.
2424 (b) The owner of a motor vehicle, trailer, or semitrailer
2525 may apply for registration under Section 502.201 and is exempt from
2626 the payment of the registration fee that would otherwise be
2727 required by this chapter if the vehicle is owned and used
2828 exclusively for emergency incident rehabilitation by a nonprofit
2929 organization.
3030 (c) An application for registration under this section must
3131 include:
3232 (1) a statement by the owner of the vehicle that the
3333 vehicle is used exclusively for emergency incident rehabilitation
3434 and has not been used for any other purpose;
3535 (2) a statement signed by an officer of the nonprofit
3636 organization that the vehicle has not been used for any purpose
3737 other than emergency incident rehabilitation and qualifies for
3838 registration under this section; and
3939 (3) a reasonable description of the vehicle and the
4040 equipment included in the vehicle.
4141 (d) An applicant for registration under this section must
4242 pay a fee of $5.
4343 (e) A motor vehicle registered under this section must
4444 display the name of the organization that owns it on each front
4545 door.
4646 (f) A vehicle registered under this section must display at
4747 all times an appropriate license plate showing the vehicle's
4848 status.
4949 (g) A vehicle registered under this section that is used for
5050 any purpose other than emergency incident rehabilitation by a
5151 nonprofit organization that provides emergency incident
5252 rehabilitation may not again be registered under this section by
5353 that organization.
5454 SECTION 2. This Act takes effect September 1, 2009.
