55 AN ACT
66 relating to the selection of early voting judges.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 85.009, Election Code, is repealed.
99 SECTION 2. Chapter 85, Election Code, is amended by adding
1010 Section 85.073 to read as follows:
1111 Sec. 85.073. Election officers serving branch polling
1212 place. (a) The early voting clerk shall designate for each branch
1313 polling place a deputy early voting clerk as the election officer in
1414 charge of the polling place.
1515 (b) Except as provided by Subsection (c), the composition of
1616 the set of election officers serving a branch polling place must
1717 provide representation for each political party conducting a
1818 primary election in the county.
1919 (c) For the general election for state and county officers
2020 and for a special election to fill a vacancy in an office regularly
2121 filled at the general election for state and county officers, the
2222 composition of the set of election officers serving a branch
2323 polling place who are not employees of the county must, to the
2424 extent practicable, provide equal representation for each
2525 political party conducting a primary election in the county.
2626 SECTION 3. EFFECTIVE DATE. This Act takes effect
2727 immediately if it receives a vote of two-thirds of all the members
2828 elected to each house, as provided by Section 39, Article III, Texas
2929 Constitution. If this Act does not receive the vote necessary for
3030 immediate effect, this Act takes effect September 1, 2009.
