| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 85.009, Election Code, is repealed. |
|---|
| 9 | 9 | | SECTION 2. Chapter 85, Election Code, is amended by adding |
|---|
| 10 | 10 | | Section 85.073 to read as follows: |
|---|
| 11 | 11 | | Sec. 85.073. Election officers serving branch polling |
|---|
| 12 | 12 | | place. (a) The early voting clerk shall designate for each branch |
|---|
| 13 | 13 | | polling place a deputy early voting clerk as the election officer in |
|---|
| 14 | 14 | | charge of the polling place. |
|---|
| 15 | 15 | | (b) Except as provided by Subsection (c), the composition of |
|---|
| 16 | 16 | | the set of election officers serving a branch polling place must |
|---|
| 17 | 17 | | provide representation for each political party conducting a |
|---|
| 18 | 18 | | primary election in the county. |
|---|
| 19 | 19 | | (c) For the general election for state and county officers |
|---|
| 20 | 20 | | and for a special election to fill a vacancy in an office regularly |
|---|
| 21 | 21 | | filled at the general election for state and county officers, the |
|---|
| 22 | 22 | | composition of the set of election officers serving a branch |
|---|
| 23 | 23 | | polling place who are not employees of the county must, to the |
|---|
| 24 | 24 | | extent practicable, provide equal representation for each |
|---|
| 25 | 25 | | political party conducting a primary election in the county. |

| 26 | 26 | | SECTION 3. EFFECTIVE DATE. This Act takes effect |
|---|
| 27 | 27 | | immediately if it receives a vote of two-thirds of all the members |
|---|
| 28 | 28 | | elected to each house, as provided by Section 39, Article III, Texas |
|---|
| 29 | 29 | | Constitution. If this Act does not receive the vote necessary for |
|---|
| 30 | 30 | | immediate effect, this Act takes effect September 1, 2009. |
