77 relating to the manner in which certain state officials request and
88 receive notice of the residence of certain sex offenders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 62, Code of Criminal
1111 Procedure, is amended by adding Article 62.0052 to read as follows:
1212 Art. 62.0052. ELECTRONIC MAIL REPORT SERVICE FOR STATE
1313 LEGISLATORS. (a) The department shall maintain an electronic mail
1414 report service to which a member of the house of representatives or
1515 the senate of this state may electronically subscribe.
1616 (b) The electronic mail report service maintained under
1717 Subsection (a) must:
1818 (1) allow a subscribing representative or senator to
1919 request for each zip code any portion of which is located in the
2020 representative's or senator's district notification of:
2121 (A) the release from a penal institution or
2222 placement on deferred adjudication community supervision,
2323 community supervision, or juvenile probation of a person who
2424 expects to reside or resides in that zip code and is required to
2525 register under this chapter; and
2626 (B) any change in address of a person who expects
2727 to reside or resides in that zip code and is required to register
2828 under this chapter; and
2929 (2) not less frequently than monthly, deliver to the
3030 subscribing representative or senator a report containing the
3131 information described by Subdivision (1).
3232 (c) The department must include any public information
3333 described by Article 62.005 in an electronic mail report sent to a
3434 subscribing representative or senator.
3535 SECTION 2. The Department of Public Safety shall have the
3636 electronic mail report service required to be maintained under
3737 Article 62.0052, Code of Criminal Procedure, as added by this Act,
3838 fully functional and able to receive subscription requests and
3939 respond appropriately to those requests not later than January 1,
4040 2010.
4141 SECTION 3. This Act takes effect September 1, 2009.
