| 7 | 7 | | relating to the manner in which certain state officials request and |

| 8 | 8 | | receive notice of the residence of certain sex offenders. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 62, Code of Criminal |
|---|
| 11 | 11 | | Procedure, is amended by adding Article 62.0052 to read as follows: |
|---|
| 12 | 12 | | Art. 62.0052. ELECTRONIC MAIL REPORT SERVICE FOR STATE |
|---|
| 13 | 13 | | LEGISLATORS. (a) The department shall maintain an electronic mail |
|---|
| 14 | 14 | | report service to which a member of the house of representatives or |
|---|
| 15 | 15 | | the senate of this state may electronically subscribe. |
|---|
| 16 | 16 | | (b) The electronic mail report service maintained under |
|---|
| 17 | 17 | | Subsection (a) must: |
|---|
| 18 | 18 | | (1) allow a subscribing representative or senator to |
|---|
| 19 | 19 | | request for each zip code any portion of which is located in the |
|---|
| 20 | 20 | | representative's or senator's district notification of: |
|---|
| 21 | 21 | | (A) the release from a penal institution or |
|---|
| 22 | 22 | | placement on deferred adjudication community supervision, |
|---|
| 23 | 23 | | community supervision, or juvenile probation of a person who |
|---|
| 24 | 24 | | expects to reside or resides in that zip code and is required to |
|---|
| 25 | 25 | | register under this chapter; and |
|---|
| 26 | 26 | | (B) any change in address of a person who expects |
|---|
| 27 | 27 | | to reside or resides in that zip code and is required to register |
|---|
| 28 | 28 | | under this chapter; and |
|---|
| 29 | 29 | | (2) not less frequently than monthly, deliver to the |
|---|
| 30 | 30 | | subscribing representative or senator a report containing the |
|---|
| 31 | 31 | | information described by Subdivision (1). |
|---|
| 32 | 32 | | (c) The department must include any public information |
|---|
| 33 | 33 | | described by Article 62.005 in an electronic mail report sent to a |
|---|
| 34 | 34 | | subscribing representative or senator. |
|---|
| 35 | 35 | | SECTION 2. The Department of Public Safety shall have the |
|---|
| 36 | 36 | | electronic mail report service required to be maintained under |
|---|
| 37 | 37 | | Article 62.0052, Code of Criminal Procedure, as added by this Act, |
|---|
| 38 | 38 | | fully functional and able to receive subscription requests and |
|---|
| 39 | 39 | | respond appropriately to those requests not later than January 1, |
|---|
| 40 | 40 | | 2010. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2009. |
