55 relating to streamlining voter reregistration across county lines.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Sections 15.052(a) and (b), Election Code, are
88 amended to read as follows:
99 (a) The officially prescribed form for a confirmation
1010 notice must include:
1111 (1) a statement that, if the voter fails to submit to
1212 the registrar a written, signed response confirming the voter's
1313 current residence on or before the 30th day after the date the
1414 confirmation notice is mailed:
1515 (A) the voter is subject to submission of a
1616 statement of residence before the voter may be accepted for voting
1717 in an election held after that deadline; or
1818 (B) for a notice delivered under Section 14.023,
1919 the voter will remain subject to submission of a statement of
2020 residence before the voter may be accepted for voting in an
2121 election; [and]
2222 (2) a warning that the voter's registration is subject
2323 to cancellation if the voter fails to confirm the voter's current
2424 residence either by notifying the registrar in writing or voting on
2525 a statement of residence before November 30 following the second
2626 general election for state and county officers that occurs after
2727 the date the confirmation notice is mailed; and
2828 (3) a statement that the voter must include all of the
2929 required information on the official confirmation notice response
3030 form.
3131 (b) The official confirmation notice response form must:
3232 (1) provide spaces for the voter to include all of the
3333 information that a person must include in an application to
3434 register to vote under Section 13.002; and
3535 (2) be postage prepaid and preaddressed for delivery
3636 to the registrar.
3737 SECTION 2. Sections 15.053(a) and (c), Election Code, are
3838 amended to read as follows:
3939 (a) Not later than the 30th day after the date a
4040 confirmation notice is mailed, the voter shall submit to the
4141 registrar a written, signed response to the notice that confirms
4242 the voter's current residence. The response must contain all of the
4343 information that a person must include in an application to
4444 register to vote under Section 13.002.
4545 (c) The registrar shall act on the response in accordance
4646 with Section 13.072 and retain the response on file with the voter's
4747 registration application.
4848 SECTION 3. Section 63.0011(c), Election Code, is amended to
4949 read as follows:
5050 (c) Before being accepted for voting, the voter must execute
5151 and submit to an election officer a statement including:
5252 (1) a statement that the voter satisfies the
5353 applicable residence requirements prescribed by Subsection (b);
5454 (2) all of the information that a person must include
5555 in an application to register to vote under Section 13.002 [the
5656 voter's residence address or, if the residence has no address, the
5757 address at which the voter receives mail and a concise description
5858 of the location of the voter's residence]; and
5959 (3) [the month, day, and year of the voter's birth;
6060 and
6161 [(4)] the date the statement is submitted to the
6262 election officer.
6363 SECTION 4. Not later than September 1, 2009, the secretary
6464 of state shall prescribe:
6565 (1) official forms for a confirmation notice and
6666 confirmation notice response that meet the requirements of Section
6767 15.052, Election Code, as amended by this Act; and
6868 (2) a form that may be used for the statement of
6969 residence that meets the requirements of Section 63.0011(c),
7070 Election Code, as amended by this Act.
7171 SECTION 5. This Act takes effect September 1, 2009.
