5	5	relating to streamlining voter reregistration across county lines.
6	6	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	7	SECTION 1. Sections 15.052(a) and (b), Election Code, are
8	8	amended to read as follows:
9	9	(a) The officially prescribed form for a confirmation
10	10	notice must include:
11	11	(1) a statement that, if the voter fails to submit to
12	12	the registrar a written, signed response confirming the voter's
13	13	current residence on or before the 30th day after the date the
14	14	confirmation notice is mailed:
15	15	(A) the voter is subject to submission of a
16	16	statement of residence before the voter may be accepted for voting
17	17	in an election held after that deadline; or
18	18	(B) for a notice delivered under Section 14.023,
19	19	the voter will remain subject to submission of a statement of
20	20	residence before the voter may be accepted for voting in an
21	21	election; [and]
22	22	(2) a warning that the voter's registration is subject
23	23	to cancellation if the voter fails to confirm the voter's current
24	24	residence either by notifying the registrar in writing or voting on
25	25	a statement of residence before November 30 following the second
26	26	general election for state and county officers that occurs after
27	27	the date the confirmation notice is mailed; and
28	28	(3) a statement that the voter must include all of the
29	29	required information on the official confirmation notice response
30	30	form.
31	31	(b) The official confirmation notice response form must:
32	32	(1) provide spaces for the voter to include all of the
33	33	information that a person must include in an application to
34	34	register to vote under Section 13.002; and
35	35	(2) be postage prepaid and preaddressed for delivery
36	36	to the registrar.
37	37	SECTION 2. Sections 15.053(a) and (c), Election Code, are
38	38	amended to read as follows:
39	39	(a) Not later than the 30th day after the date a
40	40	confirmation notice is mailed, the voter shall submit to the
41	41	registrar a written, signed response to the notice that confirms
42	42	the voter's current residence. The response must contain all of the
43	43	information that a person must include in an application to
44	44	register to vote under Section 13.002.
45	45	(c) The registrar shall act on the response in accordance
46	46	with Section 13.072 and retain the response on file with the voter's
47	47	registration application.
48	48	SECTION 3. Section 63.0011(c), Election Code, is amended to
49	49	read as follows:
50	50	(c) Before being accepted for voting, the voter must execute
51	51	and submit to an election officer a statement including:
52	52	(1) a statement that the voter satisfies the
53	53	applicable residence requirements prescribed by Subsection (b);
54	54	(2) all of the information that a person must include
55	55	in an application to register to vote under Section 13.002 [the
56	56	voter's residence address or, if the residence has no address, the
57	57	address at which the voter receives mail and a concise description
58	58	of the location of the voter's residence]; and
59	59	(3) [the month, day, and year of the voter's birth;
60	60	and
61	61	[(4)] the date the statement is submitted to the
62	62	election officer.
63	63	SECTION 4. Not later than September 1, 2009, the secretary
64	64	of state shall prescribe:
65	65	(1) official forms for a confirmation notice and
66	66	confirmation notice response that meet the requirements of Section
67	67	15.052, Election Code, as amended by this Act; and
68	68	(2) a form that may be used for the statement of
69	69	residence that meets the requirements of Section 63.0011(c),
70	70	Election Code, as amended by this Act.
71	71	SECTION 5. This Act takes effect September 1, 2009.
