55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of and funding for Saturday classes for
88 elementary school students who fail to pass certain assessment
99 instruments.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 25, Education Code, is
1212 amended by adding Section 25.0812 to read as follows:
1313 Sec. 25.0812. SATURDAY CLASSES FOR CERTAIN ELEMENTARY
1414 SCHOOL STUDENTS. In addition to classes normally held by a school
1515 district, a district may hold classes on Saturdays during the
1616 regular school year for elementary school students who fail to
1717 perform satisfactorily on an assessment instrument administered
1818 under Section 39.023(a), (b), or (l).
1919 SECTION 2. Section 42.005, Education Code, is amended by
2020 adding Subsection (a-1) to read as follows:
2121 (a-1) A school district is entitled to funding under this
2222 chapter for students in average daily attendance in a class
2323 described by Section 25.0812. For purposes of this subsection,
2424 average daily attendance is the quotient of the sum of attendance
2525 for each day a program under that section is provided divided by the
2626 number of days the program is provided.
2727 SECTION 3. This Act applies beginning with the 2009-2010
2828 school year.
2929 SECTION 4. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
