| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 25, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 25.0812 to read as follows: |
|---|
| 13 | 13 | | Sec. 25.0812. SATURDAY CLASSES FOR CERTAIN ELEMENTARY |
|---|
| 14 | 14 | | SCHOOL STUDENTS. In addition to classes normally held by a school |
|---|
| 15 | 15 | | district, a district may hold classes on Saturdays during the |
|---|
| 16 | 16 | | regular school year for elementary school students who fail to |
|---|
| 17 | 17 | | perform satisfactorily on an assessment instrument administered |
|---|
| 18 | 18 | | under Section 39.023(a), (b), or (l). |
|---|
| 19 | 19 | | SECTION 2. Section 42.005, Education Code, is amended by |
|---|
| 20 | 20 | | adding Subsection (a-1) to read as follows: |
|---|
| 21 | 21 | | (a-1) A school district is entitled to funding under this |
|---|
| 22 | 22 | | chapter for students in average daily attendance in a class |
|---|
| 23 | 23 | | described by Section 25.0812. For purposes of this subsection, |
|---|
| 24 | 24 | | average daily attendance is the quotient of the sum of attendance |
|---|
| 25 | 25 | | for each day a program under that section is provided divided by the |
|---|
| 26 | 26 | | number of days the program is provided. |
|---|
| 27 | 27 | | SECTION 3. This Act applies beginning with the 2009-2010 |
|---|
| 28 | 28 | | school year. |
|---|
| 29 | 29 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2009. |
