| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1551.101, Insurance Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (f) to read as follows: |
|---|
| 12 | 12 | | (f) An employee designated by an institution of higher |
|---|
| 13 | 13 | | education as an instructional employee working less than 40 and at |
|---|
| 14 | 14 | | least 20 hours a week is eligible to participate in the group |
|---|
| 15 | 15 | | benefits program as a full-time employee. |
|---|
| 16 | 16 | | SECTION 2. Section 1551.319(a), Insurance Code, is amended |
|---|
| 17 | 17 | | to read as follows: |
|---|
| 18 | 18 | | (a) A full-time employee and each instructional employee |
|---|
| 19 | 19 | | described by Section 1551.101(f) receives the benefits of a full |
|---|
| 20 | 20 | | state contribution for coverage under this chapter. |
|---|
| 21 | 21 | | SECTION 3. Section 1601.201, Insurance Code, is amended by |
|---|
| 22 | 22 | | amending Subsection (c) and adding Subsection (c-1) to read as |
|---|
| 23 | 23 | | follows: |
|---|
| 24 | 24 | | (c) Except as provided by Subsection (c-1), for [For] an |
|---|
| 25 | 25 | | employee designated by the system as working less than 40 hours a |
|---|
| 26 | 26 | | week, including an individual employed by the system in a position |
|---|
| 27 | 27 | | that as a condition of employment requires the individual to be |
|---|
| 28 | 28 | | enrolled as a student in the system in graduate-level courses, the |
|---|
| 29 | 29 | | system, from money appropriated from the general revenue fund, may |
|---|
| 30 | 30 | | contribute: |
|---|
| 31 | 31 | | (1) not more than 50 percent of the cost of basic |
|---|
| 32 | 32 | | coverage for the employee; and |
|---|
| 33 | 33 | | (2) not more than 25 percent of the cost of dependent |
|---|
| 34 | 34 | | coverage. |
|---|
| 35 | 35 | | (c-1) For a part-time instructional employee designated by |
|---|
| 36 | 36 | | a system as working less than 40 and at least 20 hours a week, the |
|---|
| 37 | 37 | | system may contribute: |
|---|
| 38 | 38 | | (1) the full cost of basic coverage for the employee; |
|---|
| 39 | 39 | | and |
|---|
| 40 | 40 | | (2) not more than 50 percent of the cost of dependent |
|---|
| 41 | 41 | | coverage. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect September 1, 2009. |
