7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
8 | 8 | | SECTION 1. Part 1, Chapter XI, Texas Probate Code, is |
---|
9 | 9 | | amended by adding Section 438B to read as follows: |
---|
10 | 10 | | Sec. 438B. CONVENIENCE SIGNER ON OTHER ACCOUNTS. (a) An |
---|
11 | 11 | | account established by one or more parties at a financial |
---|
12 | 12 | | institution that is not designated as a convenience account, but is |
---|
13 | 13 | | instead designated as a single-party account or another type of |
---|
14 | 14 | | multiple-party account, may provide that the sums on deposit may be |
---|
15 | 15 | | paid or delivered to the parties or to one or more convenience |
---|
16 | 16 | | signers "for the convenience of the parties." |
---|
17 | 17 | | (b) Except as provided by Subsection (c) of this section: |
---|
18 | 18 | | (1) the provisions of Section 438A of this chapter |
---|
19 | 19 | | apply to an account described by Subsection (a) of this section, |
---|
20 | 20 | | including provisions relating to the ownership of the account |
---|
21 | 21 | | during the lifetimes and on the deaths of the parties and provisions |
---|
22 | 22 | | relating to the powers and duties of the financial institution at |
---|
23 | 23 | | which the account is established; and |
---|
24 | 24 | | (2) any other law relating to a convenience signer |
---|
25 | 25 | | applies to a convenience signer designated as provided by this |
---|
26 | 26 | | section to the extent the law applies to a convenience signer on a |
---|
27 | 27 | | convenience account. |
---|
28 | 28 | | (c) On the death of the last surviving party to an account |
---|
29 | 29 | | that has a convenience signer designated as provided by this |
---|
30 | 30 | | section, the convenience signer does not have a right of |
---|
31 | 31 | | survivorship in the account and the estate of the last surviving |
---|
32 | 32 | | party owns the account unless the convenience signer is also |
---|
33 | 33 | | designated as a P.O.D. payee or as a beneficiary. |
---|
34 | 34 | | SECTION 2. Sections 439A(a) and (b), Texas Probate Code, |
---|
35 | 35 | | are amended to read as follows: |
---|
36 | 36 | | (a) A contract of deposit that contains provisions |
---|
37 | 37 | | substantially the same as in the form provided by Subsection (b) of |
---|
38 | 38 | | this section establishes the type of account selected by a party. |
---|
39 | 39 | | The provisions of this part of Chapter XI of this code govern an |
---|
40 | 40 | | account selected under the form[, other than a single-party account |
---|
41 | 41 | | without a P.O.D. designation]. A contract of deposit that does not |
---|
42 | 42 | | contain provisions substantially the same as in the form provided |
---|
43 | 43 | | by Subsection (b) of this section is governed by the provisions of |
---|
44 | 44 | | this chapter applicable to the account that most nearly conforms to |
---|
45 | 45 | | the depositor's intent. |
---|
46 | 46 | | (b) A financial institution may use the following form to |
---|
47 | 47 | | establish the type of account selected by a party: |
---|
48 | 48 | | UNIFORM SINGLE-PARTY OR MULTIPLE-PARTY ACCOUNT SELECTION |
---|
49 | 49 | | FORM NOTICE: The type of account you select may determine how |
---|
50 | 50 | | property passes on your death. Your will may not control the |
---|
51 | 51 | | disposition of funds held in some of the following accounts. You |
---|
52 | 52 | | may choose to designate one or more convenience signers on an |
---|
53 | 53 | | account, even if the account is not a convenience account. A |
---|
54 | 54 | | designated convenience signer may make transactions on your behalf |
---|
55 | 55 | | during your lifetime, but does not own the account during your |
---|
56 | 56 | | lifetime. The designated convenience signer owns the account on |
---|
57 | 57 | | your death only if the convenience signer is also designated as a |
---|
58 | 58 | | P.O.D. payee or trust account beneficiary. |
---|

175 | 175 | | provided by Section 39, Article III, Texas Constitution. If this |

176 | 176 | | Act does not receive the vote necessary for immediate effect, this |
---|
