| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 62.021(c), Parks and Wildlife Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | (c) This section does not prohibit the sale of: |
|---|
| 16 | 16 | | (1) a live game animal, a dead or live game bird, or |
|---|
| 17 | 17 | | the feathers of a game bird if the sale is conducted under authority |
|---|
| 18 | 18 | | of a license or permit issued under this code; or |
|---|
| 19 | 19 | | (2) the following inedible parts: |
|---|
| 20 | 20 | | (A) an inedible part, including the feathers, |
|---|
| 21 | 21 | | bones, or feet, of a game bird other than a migratory game bird that |
|---|
| 22 | 22 | | was lawfully taken or is lawfully possessed; |
|---|
| 23 | 23 | | (B) the hair, hide, antlers, bones, horns, skull, |
|---|
| 24 | 24 | | hooves, or sinew, as applicable, of a deer, pronghorn antelope, |
|---|
| 25 | 25 | | desert bighorn sheep, collared peccary or javelina, red squirrel, |
|---|
| 26 | 26 | | or gray squirrel; or |
|---|
| 27 | 27 | | (C) the feathers of a migratory game bird in |
|---|
| 28 | 28 | | accordance with federal law. |

| 29 | 29 | | SECTION 2. The changes in law made by this Act apply to any |
|---|
| 30 | 30 | | sale of inedible parts of an animal or bird occurring on or after |
|---|
| 31 | 31 | | the effective date of this Act, regardless of the date the parts |
|---|
| 32 | 32 | | were acquired by the seller. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2009. |
