66 AN ACT
77 relating to the penalty for a false report or a failure to report in
88 connection with certain recordkeeping requirements under the
99 jurisdiction of the Department of State Health Services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 435, Health and Safety
1212 Code, is amended by adding Section 435.015 to read as follows:
1313 Sec. 435.015. FALSE REPORT; FAILURE TO REPORT; CRIMINAL
1414 PENALTY. (a) A person commits an offense if the person
1515 intentionally:
1616 (1) makes or causes to be made a false entry in an
1717 account, record, or memorandum kept by a person subject to this
1818 chapter;
1919 (2) neglects or fails to make or cause to be made full
2020 entries in an account, record, or memorandum kept by a person
2121 subject to this chapter of all facts and transactions pertaining to
2222 the person's business;
2323 (3) removes from the jurisdiction of this state or
2424 mutilates, alters, or otherwise falsifies documentary evidence of a
2525 person subject to this chapter; or
2626 (4) refuses to submit to the department or to the
2727 department's authorized agent, for inspection and copying,
2828 documentary evidence in the person's possession or control of a
2929 person subject to this chapter.
3030 (b) An offense under this section is punishable by a fine of
3131 not less than $1,000 or more than $5,000, imprisonment for not more
3232 than three years, or both.
3333 SECTION 2. Subchapter C, Chapter 436, Health and Safety
3434 Code, is amended by adding Section 436.041 to read as follows:
3535 Sec. 436.041. FALSE REPORT; FAILURE TO REPORT; CRIMINAL
3636 PENALTY. (a) A person commits an offense if the person
3737 intentionally:
3838 (1) makes or causes to be made a false entry in an
3939 account, record, or memorandum kept by a person subject to this
4040 chapter;
4141 (2) neglects or fails to make or cause to be made full
4242 entries in an account, record, or memorandum kept by a person
4343 subject to this chapter of all facts and transactions pertaining to
4444 the person's business;
4545 (3) removes from the jurisdiction of this state or
4646 mutilates, alters, or otherwise falsifies documentary evidence of a
4747 person subject to this chapter; or
4848 (4) refuses to submit to the director, to an
4949 authorized agent, or to a health authority, for inspection and
5050 copying, documentary evidence in the person's possession or control
5151 of a person subject to this chapter.
5252 (b) An offense under this section is punishable by a fine of
5353 not less than $1,000 or more than $5,000, imprisonment for not more
5454 than three years, or both.
5555 SECTION 3. The change in law made by this Act applies only
5656 to an offense committed on or after the effective date of this Act.
5757 An offense committed before the effective date of this Act is
5858 covered by the law in effect when the offense was committed, and the
5959 former law is continued in effect for that purpose. For purposes of
6060 this section, an offense was committed before the effective date of
6161 this Act if any element of the offense was committed before that
6262 date.
6363 SECTION 4. This Act takes effect September 1, 2009.
