99 relating to proof that is acceptable for identifying individuals
1010 acknowledging written instruments.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 121.005(a), Civil Practice and Remedies
1313 Code, is amended to read as follows:
1414 (a) An officer may not take the acknowledgment of a written
1515 instrument unless the officer knows or has satisfactory evidence
1616 that the acknowledging person is the person who executed the
1717 instrument and is described in it. An officer may accept, as
1818 satisfactory evidence of the identity of an acknowledging person,
1919 only:
2020 (1) the oath of a credible witness personally known to
2121 the officer; or
2222 (2) a current identification card or other document
2323 issued by the federal government, a foreign government, or any
2424 state government that contains the photograph and signature of the
2525 acknowledging person.
2626 SECTION 2. This Act takes effect September 1, 2009.
